Legal Experts of the OT--Lady Hit My Car Door At Restaurant.

Need some advice. Here's the situation. GF and I pulled into restaurant for lunch. I pulled into clearly marked parking space and was between both lines. GF opens door to get out on passenger side. About 3 secs later, a lady pulls into the spot next to us on passenger side and hits my car door. My GF can't get out until lady backs up some. Amazingly enough, my SUV has no damage whatsoever. The lady's Prius has a good sized dent in her front drivers side bumper and several scratches and scuff marks.

We tell her we'll just let it go since there is no damage to my car. She then begins saying she's calling the police and wants to swap insurance info. I'm pissed by now as this lady is making this a huge deal. I tell her that's fine if she wants to file a claim and have her insurance go up. She says that we're at fault. I dont argue anymore b/c it's useless. Police refuse to come out b/c its on private property and really minor. She calls her insurance to make a claim and I hear her telling how it's our fault. I call my insurance and let them know what the situation is. I get a claim # from them. I told them I wasnt filing a claim as I had no damage but she gave me a claim # anyway. We also exchanged insurance info with the at fault driver.

Is my insurance going to go up b/c of this lady? I'm going to call my agent on Monday and let him know what happened. I dont want my insurance to pay for her damage as I feel she was at fault. I took pics of her car too btw. Anyone know how this will turn out? Am I an idiot for calling my insurance to let them know? I'm glad my SUV is ok but I know how sue happy everyone is these days and I'm a little anxious.

I would check if the parking area that you were in had a security camera. If so, try to get a copy of the video.

Call your insurance co. and confirm the situation and you were not at fault. They won't pay her ins. co.

maybe.....if they have to pay her.

this happened to my son the other day. got hit by a lady. cop put that, in his opinion "she was 100% at fault" on the accident report. however, she made a fricking claim and they are battling it out right now.

son's truck had no damage and she had a scratch.

Based on your version of incident + location of damage to her vehicle, she is at fault. Your ins. co. should tell her to fuk off.

I'd she called her insurance agency, yours was going to be contacted whether you told them or not.

If it happened the way you described, your insurance company will likely deny. It's not like they want to pay claims they don't have to pay.

Your insurance won't go up.

She is at fault.

You should have laughed at her and told her to hit the road or report it herself. If you didn't do anything wrong, why humor her?

You'll be fine. Tell your insurance company what happened and they'll take care of it.

Ignore almost everyone in this thread.

She was Asian btw. That should settle it right there.

If I had left and not exchanged info, what was to stop her from getting my license plate # and reporting me for leaving the scene of an accident?
