Grand Juries lean heavily in favor of the prosecution.

MS is the dumbest state in the Union.

Grand jury was absolutely manipulated by prosecutor here.

Prosecutor going for 1st degree murder hoping to get a plea for manslaughter, and I'm guessing shooter white, shootee black, so he's going for political points.

If the shooter can hire a decent defense attorney, this won't go to trial, or they'll pursue the manslaughter angle.

But this guy is going to walk. I guarantee you the jury will ask the judge if they are allowed to commend the shooter here.

Not only was it murder, but first degree murder.

What are the provisions of first degree murder in Mississippi?

IMO justified. Had he walked out and just shot the guy to prevent the theft of his car, then that's not justified (can't protect property with deadly force), however he did the right thing and simply confronted him and then they guy charged him. The deadly force could he used but the ultimate question is if it was objectively reasonable to fear for his life. That's what the jury will answer. I'd vote yes.

In this case, malice aforethought which can be formed the second before you act. In this case, the State would argue that he made the choice to go outside with a gun to kill the guy because he was stealing his car, which is illegal. He didn't shoot until the other guy charged him though, so I think that's a losing argument. Who knows in Hinds County though.

This doesn't meet the criteria. No way they'll prove pre-meditation or intent.

Manslaughter, maybe, at best.

Agreed, but they'll argue he went outside armed with the intent to kill the guy stealing his car and you can't protect property with deadly force.

In MS, the rules of court allow for manslaughter to be a lesser included on a murder charge, so the jury will be instructed on both and they decide manslaughter, murder or innocent.

Reading things like this is exactly why I don't carry a gun. Nothing but bad comes from having a gun when a confrontation happens. frick that. I'll take my arse whipping instead of killing someone

I would hope that any lawyer worth a damn would tell him not to take that deal. Call their bluff, take them to trial and make them prove murder 1. They'll never be able to do it.

That's the key to the indictment. Grand Jury didn't get to hear anything from the defense, or very little to support the defense. Instead they probably heard a prosecutor tell them "he had a gun, he ran outside to confront this man that was merely looking at his car and he said to himself, if he's stealing my car I'm gonna shoot him"

At trial this will be blown to pieces, namely through the fact that the guy didn't emerge from the building with the gun drawn.

MS is an open, constitutional carry state (conceal included; no permit needed).

Me being dead would probably be better than having to drag my family through litigation for a couple years with me possibly going to prison.
