Are they in Louisiana? If they are and there is no custody papers drawn up, then there isn't anything that anybody can do to take his kid away. If he goes and picks up his own kid from someone it is not kidnapping. It is kidnapping if he goes to get his kid from a babysitter and she refuses to give the child.

The mother and the father have equal rights to the kid, so this is NOT kidnapping (in Louisiana at least). He could go and take the kid from the babysitter and the mom can't send the cops or anybody to get the kid back.

Even with court papers, unless those papers say that the dad has zero rights to the kid, the cops can't come take the kid away from the father if he doesn't return the kid. It's a civil matter, not a criminal matter, and the mother would have to document the wrong doings, according to the judges ruling, and they go back to court.

Now is going snatch the kid away the best idea? Probably not....but he is doing nothing criminal by doing so.

From the bullshat the OP regularly posts on here about his friends, I'm thinking attending a party at Rebeloke's house would be the equivalent of slicing the skin between your toes with a knife soaked in gasoline while suffering from explosive diarrhea and sitting in a fire ant bed next to a hornet nest.

This. Keep a log/journal. Record all you conversations. Keep receipts for every dollar you spend on the kid.

Best thing for your buddy to do is to get good representation, take lots of notes, photos, etc. Follow every conversation he has with his ex with a Text. Record conversations. And hope you can get a judge thats not a complete arse clown.

In Louisiana, this is blatantly false. They are still married and their is no custody agreement in force. As mentioned in prior posts, This is a civil matter. Now if the father takes the child, moves cross country and changes his last name that's a different story.

You go take a kid from mommy while separated and let me know how that works out for you. She will call the cops and tell them you kidnapped her kid, and we'll be seeing that amber alert notice all through the football game.

This baby is 10 months old? How many new mothers worth a frick have left an infant for any length of time with anyone that wasn't consistently a part of the child's life, a grandmother or something? Most new mothers I know wouldn't dream of it for well over a year or so and even then, it's akin to leaving an addiction for a night. I could be wrong here but that seems to be my experience as a godfather to 2 children...

My advice...

Tell your boy under no circumstances-- not if, but WHEN his plan "blows up in his face"-- is he allowed to get physical with this broad. He will have that kid taken from him for good if he loses his cool.

Play it cool, love on the kid as much as possible if he gets the chance, feel rewarded from the time spent with his own flesh and blood. Then... in due time...

HANDLE HIS BUSINESS IN COURT, The only way this will end well for the CHILD, is if DAD man's the frick up and puts his child first. That's what fathers do.

It bears repeating, tell him DO NOT GET PHYSICAL.

Women can be such bitches about this stuff. My bro pays child support and only gets her every other weekend for a total of 48 days a year, not including holidays, etc. Well she bitches about not getting the child support on time, etc yet she plans stuff for the weekend he is supposed to get her and acts like 'oh well'.

I mean how can women be automatically awarded custody most of the time, when they aren't no better raising kids than men. Shitty parents exists in both sexes.

My friend caught a break. The plans blew up because his papers for separation got served and the trip got canceled. The OT is a legitimate place of support. Thanks guys.
