Good luck man. Recently heard a story about custody and divorce filings that made me lose faith in the judiciary system when it comes to this shite. Being the male in the divorce, the law is not on your side at all, so I hope you have plenty of proof to support your cause. Sad what women can get away with in this shite.

I've been divorced for 4 years. We had 2 kids together.

Our divorce was emotional but ended in an amicable 50/50 custodial arrangement. She bought my equity out of the marital home and lives there today. I bought another house in the same school district making things easier for the kids.

The only thing that bit me in the arse was allowing the exwife to be named as domiciliary. It has created minor headaches with the school.

This is actually not the case in most instances. Most courts have taken a strong stance on fathers rights, especially in Louisiana, over the past few years.

Did she move out of state? how long has she been gone? The father only has a limited amount of time to contest the move until the child's residence is established in the new location. Your friend better get on his horse.

He needs an attorney yesterday. If he is living in the family home, he can show that the wife abandoned the family. Speak to an attorney before doing any of this stuff.

This is what I thought as I read the entire thread!

That would explain why the mother has not solidified any custody agreement yet! She is waiting for a kidnapping charge against the father so she gets full custody....

What does having kids have to do with realizing what you said he's thinking of doing is a horrible idea?

Your friend is letting emotions override his common sense. That most often results in a person acting in a way that they will regret later. Or maybe he doesn't have common sense in the first place. Or maybe you're trolling and none of this is real.

He is stupid - she can't keep him from seeing his child - he should have gone to the courts 3 months ago. How has something been filed but not served??
