This is the easiest option for now. Just call him, or email him, and say you have plenty of copies of the lease with his signature on it and if he wants to be civil and return the money you won't pursue him in court.

well, in the good old days

he'd get visited by a few friends and get convinced to square up what he f'd up

you need to talk FACE to FACE ....demand return on money.....make sure you are alone

you can't small claims him simply due to lack of evidence

do you do social media? you can turn up the heat on him there....don't over do it tho.

taking pix is protection for landlord and renters too.

taking pix of rent/lease agreements too

he has no proof

his only option is a direct confrontation demanding retrun of funds, not asking if he took it [ that's a setup for failure ]

court would be a waste of time....without a confession

I'd confront the man face to face, demand the money, and if he didn't return it, file a police report....but still a report without proof is pretty toothless...then just move on. never leave cash out anywhere

This is the angle I was hoping would support some sort of validity. He has mail coming here, he made deposits into my checking account, and my other roommate supports the situation of what's going on.

I know, I messed up, I get it. I was too trusting, just a mistake. I get that. I am just trying to make the losses as little as possible, but yes, I know moving forward things to do to avoid this fiasco was happening, again.

It is not going to be worth the cost to pursue him legally.

You can call the small claims court in Oxford and see what it will cost you to sue him and to serve papers. You can do that without a lawyer. Trouble will be convincing the judge the terms of the lease. Do you have it on a computer unsigned even?

Probably best to mark him down as a low life POS and get another room mate. Collect a big deposit up front.
