u could always bluff and tell him you have a scanned copy of the lease and to return the money or you will take him to court for the remainder he owes on the lease
This is the easiest option for now. Just call him, or email him, and say you have plenty of copies of the lease with his signature on it and if he wants to be civil and return the money you won't pursue him in court.

ETA: I just noticed your location says Oxford. This guy claims to have studied at Ole Miss. It's probably supposed to be the same person.
Facebook is gone now it seems....hmmm......
Whats up Derwin. I know you're here.

sue his arse and record the judgment so this frickstick doesnt do this again. And run credit on you potential renters...
Posted on 10/3/15 at 11:14 am to rpg37
well, in the good old days
he'd get visited by a few friends and get convinced to square up what he f'd up
you need to talk FACE to FACE ....demand return on money.....make sure you are alone
you can't small claims him simply due to lack of evidence
do you do social media? you can turn up the heat on him there....don't over do it tho.

Obvious answer is obvious.

you were not paying attention bro
he has no proof
his only option is a direct confrontation demanding retrun of funds, not asking if he took it [ that's a setup for failure ]
court would be a waste of time....without a confession
I'd confront the man face to face, demand the money, and if he didn't return it, file a police report....but still a report without proof is pretty toothless...then just move on. never leave cash out anywhere

Actually, you do have some type of proof. You have the other roommate. He can vouch that the lease exists because he was also on the lease. You also have the email you sent him asking him to return the key and garage door opener. I would assume he also had mail coming to the address which would establish he lived there. Simply stealing the lease does not erase his living history there.
This is the angle I was hoping would support some sort of validity. He has mail coming here, he made deposits into my checking account, and my other roommate supports the situation of what's going on.
I know, I messed up, I get it. I was too trusting, just a mistake. I get that. I am just trying to make the losses as little as possible, but yes, I know moving forward things to do to avoid this fiasco was happening, again.

You can say that shite again. And they act like they know what they're talking about.

You should have called the police immediately and filed a report. Now you have no proof you are even insinuating he stole the cash.

It is not going to be worth the cost to pursue him legally.
You can call the small claims court in Oxford and see what it will cost you to sue him and to serve papers. You can do that without a lawyer. Trouble will be convincing the judge the terms of the lease. Do you have it on a computer unsigned even?
Probably best to mark him down as a low life POS and get another room mate. Collect a big deposit up front.

and get a fricking notary
[quote]Notary publics witness document signings to ensure the identity of the signers. Notarization of signatures helps prevent fraud and identity theft. In long-term rental agreements known as leases, notarization ensures that the landlord, renter and any guarantors or cosigners signing the contract do so of their own free will and have the authority to do so.
Multiple Year Leases
States may impose a notarization requirement on certain leases. For example, Washington and Ohio require that leases of more than one year have a notary seal. Washington requires notarization for a lease lasting more than 12 months and Ohio requires notarization for leases lasting longer than three years. Without a notary seal, lease terms that exceed one or three years in these states may be deemed month-to-month tenancies by a court.
