Former roommate - stole and left - anything we can do?

Three of us living here. One guy starts sleeping at his girl's place every night. Leaves high and dry Tuesday. He does not leave the key, though. I call my lawyer and he advised us to email him requesting the key, garage opener and a portion of the October rent. We send the email. He comes and he puts the key and opener on the ground in my room. What is missing in my room, though, is on my desk the other roommate's rent (cash) and the lease agreement I had opened because I was reading it to my lawyer the night before.

So, he has the only signed copies of the agreement. I own the house and rent out my spare rooms. It is virtually impossible to prove he stole it, although we know he did. My question is what about the lease.The three of us are the only ones who know it exists. Did him stealing that mean he beat us on this one? All we have now is texts showing he made payments and paid a deposit and Sept. payment.

True. If he stole the lease that proves he agreed to be a tenant....one would assume he destroyed it.



So now he has no way to prove he legally had a right to be in the home. Call the police and say he was trespassing and stole the money.

You could always bluff and tell him you have a scanned copy of the lease and to return the money or you will take him to court for the remainder he owes on the lease

In the OP it clearly says he emailed him REQUESTING that he come to the house to return they key and garage door opener.

Tell the roommate that you have security cameras, that he's been backtraced, and that consequences will never be the same.

I'm confused, it sounds like he paid for September and moved out on the last day of September. He may have stolen the other guy's rent for October, but you should still have the stealing guy's deposit right? If that's one month of rent, I'd say just call it even and keep his deposit. That'll cover the month until you get a new roommate. And this way you don't need to get a lawyer involved over $500.

And did you ask the guy why he took that stuff? He might have stolen it, but maybe he thought it was his deposit being returned to him with his copy of the lease? Just a thought, though the guy probably stole it lol

Maybe the other roommate staged it to look like the dude who moved out stole the money.
