How about the car stopped in the left lane, no matter for how long. I'm not saying she's 100% at fault but if she doesn't leave a parked car on the highway, this doesn't happen.

Jail doesn't cure stupid or prevent stupid people from doing stupid things. I'd be ok with taking her license away for life but jail is pointless in this case.

Probably a lot. Sounds like she admitted to purposefully stopping in the travel lane.

We'll agree to disagree on the jail time, but agree on the prevention part.

I agree, but I wonder if she would have faced ANY criminal charges if she just broke down and stopped in left lane causing a wreck....
ETA: Looks like she should have just STFU and lawyered up!!!!

If she had time to park and get out. How can you possibly say the motorcycle did not have enough time to react?
There is a reason why its so difficult to prove that the lead vehicle is responsible for a rear end collision.

even though stopping in the left lane is stupid, running into a parked car stopped in the left lane is stupider.

True, but by the same token if the motorcyclist is paying attention (assuming there is nothing important being left out of the story) then this doesn't happen.

She's likely a very kind, soft hearted person who was broken up by this and was willing to tell the cops everything to assist.

Vehicle braking is not negligent. Purposely parking on a travel lane and causing a death is negligent
Posted on 6/21/14 at 11:36 am to Antonio Moss
Very much so, I believe his negligence is as much a part of this as hers.
This is assuming she was stopped long enough to actually park the car.

Yeah it's def negligent but I've never seen someone face life in prison for negligence.

She stopped in the damn middle of a highway and caused two people to be killed.
frick her for being a dumb bitch.

Don't know the laws, but I don't believe you are supposed to stop/swerve for animals on the roads. I also see this took place in Canada, so who knows.

The OT never ceases to amaze me.

What if I pulled over to check my tire, and some idiot runs into my car killing himself?
I shouldn't be responsible for that. Pay fricking attention to the road.

From the standpoint of insurance companies in the US, at WORST she'd be found 50% responsible given what we know at this point.
Not even negligent. This would have been investigated by police and nothing more would have happened.
