The OP should add the new links to the OP.

even though stopping in the left lane is stupid, running into a parked car stopped in the left lane is stupider.
It was a highway and she stopped on purpose. This wasn't a 25 mph residential zone.

I'm not a hippie freak but I care more about animals than humans. I'd feel worse if I killed a dog with my car than if I killed a human.

Tessier said she noticed that the parked car did not have its hazards on and the driver’s door was open. As she looked back in her rear-view mirror, Tessier said, she could see the back end of Czornobaj’s car lift up in the air.
Yeah, this would explain the high level of penalties they are trying to inflict on her. Still, life is a bit extreme even if she is flat out retarded.

Shouldn't face life, but it's a really fricking stupid thing to do.

wtf
I ran over a cat on the highway recently. I'm an animal lover so it sucked, but I didnt have time to react since I was going 50+ mph. It sucks a lot, but it was preferable to slamming on my brakes and causing a pileup or swerving into the lane next to me at the risk of causing a serious accident. There's a reason they teach you in driving school that the best thing to do is keep driving through.

Well before the animal loving hippies come out, how would you feel if that was your 16 yr. old daughter that died?
first off, why is a 16 year old girl on the back of a bike?
second, how fast are you going that you can't see a car stopped in front of you?

From a liability point, you guys are WAY off on point.
On a highway or interstate, when someone stops a car in a traveling lane without emergency flashers, it is almost impossible to tell that it's not moving from behind. Especially if there is a car in front of you that happens to switch lanes suddenly. Usually, you would see a brake light if they stop or slow. But once they put it in park, with no flashers, it's very difficult to tell they are not moving. Try it.
16 year old on back of bike is completely legal.
The car driver is 100% liable. A world class attorney may be able to argue 5-10% on the motorcycle driver, but at most, that's it.

I don't care if it's legal. it's not safe.

Oh, I thought you were discussing legal liability. That's what I was discussing. Yeah, I guess everyone has an opinion on what's safe.

You don't know the details. It could have been in a curve, could have been getting dark.
I wouldn't let my sixteen year old on a motorcycle but that doesn't mean they shouldn't be allowed just so some dumbass can park her car in a traffic lane

It's also not safe to stop a vehicle in a lane on the interstate. I can't believe some of you arse clowns think it was the motorcycles fault for being there.
Posted on 6/21/14 at 1:23 pm to Jack Daniel
Driving a motorcycle is more dangerous than stopping in the left lane.

Having come up on people driving the wrong way on the interstate
And cars completely stopped in a travel lane......
Kinda come up on you pretty quick that they are doing either

Without knowing the details a several questions come to mind:
1. Why didn't the woman pull of to the side of road to help the ducks?
2. Why was the motorcyclist apparently traveling at such a high rate of speed with his daughter that he could not see the woman's car and avoid an accident?
3. I mean what if the woman had to stop for any number of other reasons? Hell in a routine traffic situation in the U.S. it would be the motorcyclist rear-ending the woman who would be considered at fault in such a similar scenario.
