read the statute. 75 on the basin is not gross negligence. period. since a busch league atty can show thats common speed. i wouldn't convict the guy if i was on the jury. now 100mph, unrestrained kids? maybe

I mean I know we'd all like to think we would act like Jeff Gordon when something wrong happens with the car, but a blown tire can send a car moving in a direction the driver may not be familiar with. And last time I checked a driving test doesn't have a blowout simulator during it.
Obviously I don't know everything at hand here, but when you're driving and the only death is a passenger in your car I really don't see the need for negligent homicide charges. Again, if the driver was impaired then I understand vehicular homicide charges. But negligent homicide when your actions killed someone close to you...I think they've been punished already. Throwing them in jail does nothing.
