The daughter lying about him being an intruder and him refusing to follow instructions buys the dad enough leeway to get off, as a reasonable person would see this as a case of the dad being fearful of his family's safety.

If this is how it went down, he'll get off in Texas.

Why should he have to prove self defense? The guy was in his house without his knowledge.

Because other people live in your house, they have the ability to give people permission to enter the property. If you don't agree, you can ask them to leave, you cannot declare them trespassers and shoot on sight.

Sad situation. That's all we know at this point. Facts could obviously sway it either way.

In all honesty, the kid shouldn't be dead. But he had to have known her parents were home. Play dumb-arse games, win dumb-arse prizes. Everybody's life is fricked up at this point, except his, which is over. Sad deal all around.

Let's not bicker and argue over who killed who.

This is a happy occasion.

We are here today to witness the union of two young people in the joyful bond of the holy wedlock. Unfortunately, one of them, my son Herbert, has just fallen to his death.

I blame the daughter. She knew who was home.

Not sure if this has been covered yet and it's a long thread but...

A 17 y/o with a 16 y/o is stautory rape, correct?

I go over this with my son constantly. You are in charge of you. Make good decisions. We have yet to be challenged by hormones though.

That guy is huge. Big guy like that feel the need to gun down a 17yr old?

If it turns out the kid killed was totally innocent..whether she lied or not, the daughter and father need to do some jail time

I don't think so in Texas, looking it up it says 17 is age of consent, but if within 3 years it's fine unless under 14.

Stautory rape is an adult having sex with a minor. Being that the age of consent in TX is 17, she is a minor.

However, Dam Guide is correct...

quote:

The age of consent in Texas is 17 (Texas Penal Code Section 21.11). However, "...It is an affirmative defense to prosecution under this section that the actor...was not more than three years older than the victim and of the opposite sex...(and) did not use duress, force, or a threat against the victim at the time of the offence" and is not a registered sex offender

Some states do not have a "close-in-age" exception and it would be stautory rape.
