I don't like pushing cops like this but, this is what its come down to concerning gun rights.

Here's the issue I see:

He violated no laws even after he was questioned and subsequently illegally detained (in my mind).

The officer was calm, cool and collected and went through what he thought was the proper protocol but it turns out he had no legal right to do what he did.

If all of you people feel so strongly that he shouldn't have the right bear arms and that that right should NOT be infringed, then work to get the laws changed. Just because the Supreme Court ruled that something is unconstitutional doesn't mean that can't be changed if the citizenry wishes.

As it stands now, this individual didn't need to identify (in Texas)even his name nor submit to questioning. And should never have been detained. That's 100% the law.

If that is their only reason for the stop, yes.

The department will issue a public apology and declare a change in policy, or they can deal with my attornies.

I don't print, nor have I opened carried since 2005.

No one should exceed their authority.

i think you misunderstand the opposition. No one(or very few) thinks he violated any laws. Attention whoring in public with guns is simply a bad idea, and has the potential to get non-gun owners in such a froth, that they might push to get laws passed that actually do affect our right to bear arms. Or it might get you shot, if someone views you as a legitimate threat. Perhaps a better question is, what did he accomplish positively by walking around town open carrying?

Got a couple pages in and still haven't seen it mentioned that open carry is illegal in Texas, or has that changed?

Most of the current restrictions on voting are also restrictions on owning a firearm, so I'll ask again, how do you feel about voter ID laws? They are an infringement on citizens right to vote, are they not?

Then get the law changed to require those openly carrying to submit to providing identification. Texas state law does not require that.

When purchasing a firearm you are required to prove who you are and submit to a background check. In many places, one doesn't even need to show ID to vote. So you might want to rethink that one.

As the law stands now, this guy did nothing wrong. If you don't like his actions or legality, then try to get it changed.
