If you look at the pictures posted on Nola.com, that is definitely his forearm. And looking at the other pictures, he was partially out of the car as in one of them you can see his feet on the ground after falling with the arm onto the steering wheel.

Also, why does it matter if Hayes wasn't the aggressor? Maybe Will Smith did hit him and drive away, maybe Smith got out first and started the argument. But that is a justification for pulling a gun on Smith and shooting him multiple times how? If it is next time I get into an argument with someone I'll pull out my gun and kill him, I'll just make sure I'm not the one to start the argument.

This sounds like a Lawyer knows he has no chance, so he is grasping at straws hoping to reduce the guy's sentence. Maybe he is hoping for a plea deal, so he is playing up this he wasn't the aggressor to get a deal.

You shoot a guy in the back when he is getting back into his car and also shot his wife in the leg. You going to jail dude.

I have noticed this board had a complete 180 since the Zimmerman case. I am seeing the exact opposite opinions posted now

This is the most important part of the prosecution's case, imo. Even if Smith did verbally state he had a gun and was going to get it from his car when he was shot, Hayes still had the opportunity to flee the scene. At the moment Smith was shot, Hayes was not in imminent danger as Smith was not charging him or pointing a weapon at him (as far as we know).
