safe to say this lawyer wont have much of a career in new orleans since he is representing someone that killed a former saint player.

You also cant escalate a situation and then claim self defense. So if this guy got out of his truck and went up to smith hollaring and shite, he has no chance.

If you look at the pictures posted on Nola.com, that is definitely his forearm. And looking at the other pictures, he was partially out of the car as in one of them you can see his feet on the ground after falling with the arm onto the steering wheel.

If that's the case, how did Smiths' wife get struck in the legs?

I actually think his lawyer is running for judge pretty soon

You're right. I went back and looked through all the pictures and saw what you described.

it really sucks what happened but I'm not clicking that link for shite.
i keep thinking how things don't make sense here yet I don't want to hear any further details.
I mean no one wins here so what's the god damn point?

Jury selection won't be fun for this case anyone who is even a slight saints fan will be bias. I guess they need to find cowboy fans

it claimed he was one of the shooters, but he admitted to not even knowing he was named in Hayes' lawsuit vs NOPD.
I'm no lawyer but I can't believe he wouldn't have known that.

Also, why does it matter if Hayes wasn't the aggressor? Maybe Will Smith did hit him and drive away, maybe Smith got out first and started the argument. But that is a justification for pulling a gun on Smith and shooting him multiple times how? If it is next time I get into an argument with someone I'll pull out my gun and kill him, I'll just make sure I'm not the one to start the argument.
This sounds like a Lawyer knows he has no chance, so he is grasping at straws hoping to reduce the guy's sentence. Maybe he is hoping for a plea deal, so he is playing up this he wasn't the aggressor to get a deal.
You shoot a guy in the back when he is getting back into his car and also shot his wife in the leg. You going to jail dude.

This is the most important part of the prosecution's case, imo. Even if Smith did verbally state he had a gun and was going to get it from his car when he was shot, Hayes still had the opportunity to flee the scene. At the moment Smith was shot, Hayes was not in imminent danger as Smith was not charging him or pointing a weapon at him (as far as we know).
