I watched it. I feel that I need more information to formulate an opinion on what the lawyer said. I certainly don't feel that Hayes had reason to shoot Smith.

Edit: The lawyer's claim that there is 911 audio and eye witness accounts that would corroborate his story will be vetted.

So let me get this right since I'm no lawyer and this is from the video:

Hayes was hit, whoever hit him ran off, he called 911 and tried to chase after said hit and run suspect.

Following that, he hits Will Smith, gets into a confrontation with Will Smith, and now shoots Will Smith to death?

ETA: and to say your client stayed at the scene of the crime so he cant be a bad guy is stupid AF

Yes. A rear end accident gives you license to kill.

Also lawyer appears comfortable that will may have been drinking

They lawyer didn't tell the shooter's side of the story of the actual shooting. It seemed like posturing to me.

In CCW class the instructor clearly explains that you do not have the right to fire a weapon at someone (self defense) unless you or someone with you are in imminent danger, and you cannot remove yourself from the situation. If they had a verbal altercation and Smith walked back to his vehicle, following him to his vehicle would be an example of being the aggressor and self defense would not be applicable. Hayes could have easily gotten back in his car or called 911 again.

It's not stupid from the lawyer's standpoint, he probably doesn't have a whole lot to work with at the moment.

From early reports, Smith was in the driver's seat and the wife in the passenger's seat when they were shot, was that confirmed?

Gotcha.

Trying to think outside the box here, short of Smith having a weapon from in the car, I can't see many other examples that could legit count as self defense for the shooter.

Yea, that's all I can really think of. Unless he thought he was reaching for a gun.

But it being a "hit" makes even less sense. The eyewitness said he heard them arguing for what seemed like a minute or 2. If he wanted him dead he would have shot him and fled. Instead they argued, he ended up shooting Will, and he remained on the scene.

that lawyer also won't be on the case very long... so what does he care about what he says

Lawyer maked it sound like Hayes called 911 after shooting Will until the follow up question.
