While it is not a disability it is a disease.

While any person knows this came after they could not reach a settlement, and is but the first shot fired in the battle over money. You hope through all of this he gets help and wants to truly help himself.

This sets a very big legal precedent for not only that state but others. I honestly wish they could come to an agreement and not do this in the public forum, because many more lives could be seriously harmed and affected.

A good lawyer will defeat any motion to dismiss by claiming those reasons are pretextual for the real reasons they terminated him - his disability.

Exactly. Bear Bryant and Adolph Rupp were notorious drunks, but they won and were protected by a complicit, friendly media. Sark didn't win.

Are healthcare workers exempted from this "protection"? Plant/Crane operators? If alcoholism is a disability, then addiction is as well. Why wouldn't anyone terminated for a failed piss test just start suing? A judge is now assigned to determine the difference between an alcoholic needing help, and a drunk who doesn't want it?

Par for the course for Cali...but damn.

Really? What is this lawsuit saying or asking for? He needs 12.6 million dollars to motivate him to get help? The school not forcing him to get help caused 12.6 million dollars worth of damage? Even though he has publicly said he doesn't need help.

Why is he suing? Because right now, I'm leaning towards not caring if he gets help.

Good, maybe now Haden will finally be relieved of his duties. This will go down as one of the worst hires in CFB history.

I want to say the case that set the precedent in California involved a middle school or high school teacher.

Okay I spotted this shite a mile away but didn't say anything. You can't fire an alcoholic for being an alcoholic. You CAN fire an alcoholic for drinking on the job. That is why the delay when the drinking stuff first came to light. They had to talk to their employment lawyer and do some digging.

Mother fricking drunks using a law for real cripples. SMH.

Actually, I believe the teacher in California was hammered in front of his/her students. I remember being shocked at the facts of the case. I am looking for it now in my emails.

Not so fast. It definitely can be considered a disability under the ADA. Almost anything can now.

Which hire? Haden, sark or Helton?? I think the sark hire was the best of the 3. The Helton hire was god awful, but Haden hired him and the hiring of Haden as AD has been the single biggest screwup by usc.

If I recall correctly, Haden asked him to seak treatment after the Salute To Troy debacle and he agreed but said he wouldn't do it until after the season.
