It would cause no more legal issues than any non P5 team left out.
But I'm all for it. If they want their own division, do it with the real power teams that carry the water...not those that are decent because of the massive TV dollars they get by virtue of their sheer presence in the conference. But it would likely be 32 teams, not 64.
They can play themselves and have NFL model. See how well that does with TV et al.
