temp agency fee question, please help

I went back to school and graduated after a 3 year hiatus and have spent about 4 months trying to get my foot in the door somewhere as a business analyst. I took a job through a temp agency doing data entry for a small e-commerce business, and they decided to create an analyst position to keep me. They made me a verbal offer, but now the temp agency is demanding 24%?! of my annual salary, and this business can't afford that, and what they can afford they can't simply pay all up front like this agency is demanding.

how the hell is this legal given that I didn't sign anything acknowledging this insane fee and neither did the company? How can they actually expect this business to pay five figures just to hire me, and what is my best course of action?

One of you probably did sign something, most like the company did. I used a temp agency once while unemployed and I'm pretty sure they communicated to me that there was a "finder's fee" if one of my assignments offered me a full time position.


I do kind of see both sides. It's not likely the company would have found you without the temp agency, but the fee the temp agency charges is ridiculous.

This sounds very fishy. On what basis do they claim this right? Do they have a contract with you and/or the business that wants to hire you?

The company almost certainly signed some sort of agreement stipulating such a fee when they contracted with the agency for your services. It is SOP for the temp industry to charge fees when a temp moves to a permanent position as a result of the agency's original placement. I seriously doubt the e commerce business dialed up a temp agency and you appeared to work without any documents being signed. It should be a giant red flag to you that the firm wanting to hire you didn't understand how temp to permanent staffing works, that they didn't read the agreement with the agency, and that they're now trying to back out of a verbal offer to you bc they failed to understand the costs related to hiring you from an agency.

I have used a temp to hire before (as an employer) and they have always explained the fee to hire full time. Sounds like your want to be employer didn't take time to read their contract.

I own a staffing agency and a couple of things--

You are the staffing agency's asset; they don't have any other products they inventory.
How long have you been with the temp agency working for this company?

My terms are work through my agency for at least 90 days and I charge my customer zero fee to make my temporary employees their permanent employees if they go the full 90 days.

In my opinion, if you have done this and the agency is still trying to charge the 24%, they suck and won't keep many long lasting relationships.

If they hold the company that wants to hire you to this 24% fee, do you think your company will ever use this temp agency again? Not likely. These fees are ridiculous and do nothing but put a bad taste out there for temp agencies.

I have never charged the fees if the 90 days has been met. If someone asks me for a perm placement, I charge between 10-15%.

I was placed at an accounting job via Robert Half years ago.

Obviously the company pays a fee to Robert Half for finding potential candidates, but I also found out that the company had to pay a fee to hire me on as a full time employee.

It's likely the company you are working for signed an agreement stating such.

At no point was I liable for any buyouts or fees.

I've worked as a temp for about 6 weeks, but the original assignment going into the job was only supposed to last 6 weeks. By asking for 24%, they're basically trying to say that I would have worked as a temp for them for a year if I hadn't been hired, which is insane. I was clear with them that I just wanted the temp job to bridge the gap for a few months while I tried to find a permanent position as an analyst, and that if I couldn't find anything I would move back to texas.
