Is it unethical to use vacation days after giving 2 weeks notice

Gave my 2 weeks notice today and my last day is Friday March 10

I have 5 vacation days that I won't get paid out for. Would it be in bad taste to use any of them.

Nope...if you were going to be compensated for what you accumulated, it would be different.

Hell no. I would talk to your boss. If they are yours and they won't cut you a check for them, use them.

I do get paid out for vacation time earned, the 5 days I have are 3 floating holidays and 2 "flex" days that I don't get paid out for.

Most companies require at least 2 weeks notice to take any vacation, so you would probably be violating that policy by taking it without enough notice anyway.


It's also pretty normal that you have to work your entire 2 weeks notice to be paid out excess vacation time. How confident are you they would approve the time off with such short notice, and with your pending departure?

They have to pay you for that shite anyway. So my answer is no.

ETA: nevermind didn't read the entire post. That's fricked up they don't have to pay your accrued vacay

most companies are lax on that policy...it's in our handbook but never enforced

Chances are you've earned them. Get them in cash instead if you want to continue working up until your last day.

Some companies you actually have to earn hours toward your vacation which is jacked up.

Depends on where you work. In most places it is still a matter of employer policy as to whether you are entitled to pay out of unused vacation at termination.

Agreed. But an employee trying to take vacation during their two weeks notice may seem an opportune time to enforce it though, right?

Yes..I wouldn't do it. Defeats the purpose of a two weeks notice if you aren't going to be there anyway. I also would not give a positive review of someone if ever used as a reference.

Hmmmmmmmmm I don't think you can use those floating holidays until those holidays have been observed or unless you will stay on with the company. I'm pretty sure they are voided if you leave before the observance of said holiday.

At my last job my vacation time was paid out, but I was going to lose sick and personal time. So I called in everyday for my 2 weeks notice and used sick and personal time to cover it.

This is not the same as unpaid vacation time. Sucks, but I'm not sure if there's anything you can really do about it...talk to your boss and ask if he'll approve you taking off and if there are any repercussions
