The weather blew my neighbor's tree onto my fence today.
Who is legally responsible to fix the fence?

During Katrina my parents neighbors tree fell on our house. My parents wanted her to get it cut down well before because it could kill someone in a storm. Came very close actually but stopped right above a bed.

I believe it depends on the tree. (e.g., If it was a healthy tree that had no reasonable threat of falling and damaging property, it's an act of God and it's your/your insurer's responsibility.)

Id call my insurance co of the cost of the fence were greater than my deductible. If not, id go get a chainsaw, stop being a girl, cut the tree up, and fix the fence.

File an insurance claim. That's what you pay homeowners insurance for.

more bad news is you'll be out of pocket for your deductible for his tree falling on your fence, and your premium may increase because of the claim.
