I never attempted to lay out a standard, other than saying judges aren't allowed to delve into weight of the evidence, as that is the fact finder's role. The actual standard, which I just posted, considers that aspect crucial. As such, I'm curious how it wouldn't comport with my previous post

I meant that if the judge took it upon themselves to determine the weight of the evidence presented instead of viewing all evidence in a light most favorable to the prosecution, it would have been an abuse of discretion to then grant the motion on those grounds.

To reiterate, although I haven't been watching, it seems as though if you viewed all of the evidence in a light most favorable to the prosecution and made no determination that some or all of the evidence isn't credible, I don't see how the motion could have been granted.

Well some people believe in the rule of law and if the evidence wasn't there the judge should acquit, even if some people don't like the appearance of justice.

Dude it really doesn't work without acknowledging that the water Buffalo Nancy Grace somehow got you to this point. Add this gem and you would have the essence of Rexy oozing thru every post.

The Ed Show had a audience behind him cheering when the motion was denied. The media spin is pathetic. From what I have seen the state has not proven its case. It did the best it could but its just not there for the charges and if he is acquitted the Ed Show will be a Wisconsin recall all over!!

Regarding this request being denied, this was not surprising. The judge is incompetent, and is hostile to the defense.

Should it have been dismissed based on evidence presented by the state? Absolutley. The state has put on a circus in this trial. The defense could call no witnesses and get an acquittal IMO.

The fact a 2nd degree murder charge was given is a joke.

I've watched the trial every day. I don't watch the news coverage, just the actual trial streamed.

The entire thing is a farce.

Why this ever went to trial is beyond me. Zimmerman was getting his arse handed to him by a 14-year old, screamed like a 13-year old girl, and luckily for him knew how to use a gun before he gotta beaten to a pulp.

I'm not saying that evidence of him smelling like piss and shite should have been admitted into court ( because I'm sure he shat his pants at some point), but he definitely lost his shite that day.

And for the record, Trayvon Martin was definitely a bad kid and probably up to know good that night
