i don't exactly know the details of the EO, but if those funds are related to immigration it's going to be REALLY hard for the states/cities to make an argument

there's a 5-point test

quote:

The spending must promote "the general welfare."
The condition must be unambiguous.
The condition should relate "to the federal interest in particular national projects or programs."
The condition imposed on the states must not, in itself, be unconstitutional.
The condition must not be coercive.

Seattle is actually in compliance with the federal law the EO cites and always has been. It's almost like the mayor is intentionally trying to pick a fight with Trump for political reasons.

No it dosnt Toddy I agree, especially when the family is ripped apart by an illegal rapist at school, or when a family is ripped apart because of their loved ones being killed by an illegal killer.

OK, the bad-faith use of states' rights arguments by these cities is beyond palpable...also, regarding Federal funding, is not precedent already established in South Dakota v. Dole?

So question for the lawyers (SFP): any guess on how long it takes for what appears (to a layman) to be a frivolous case to get thrown out?

There argument is stupid. The feds are threatening to withhold funding that is part of an agreement the states have made in regards to federal la in this area. That has been held as Constitutional.

What the feds could NOT do, is say "okay we're cutting money from education because of sanctuary cities" that would be unconstitutional.

Where exactly does states' right fit in with receiving Federal money? Seattle wants the Feds' money but wants to be completely free legally to do as it pleases with it. Don't think that's how it works.

Toddy, if you were not in flagrante delicto with a certain other Ole Miss person of Fox News, and actually understood federalism and the Tenth Amendment....maybe they don't teach that kind of stuff at U of M Law..... then you would know that the City of Seattle has no standing on the issue under that provision.

Maybe the boys in Olympia could, but the fools on the Seattle City Council do not. That being said, I'm sure there is a federal judge in Seattle who has never cracked open a Con - Law book who will rule in favor of the Plaintiff in the matter and there will probably be at least 2 Appeals Court guys on the 9th who definitely never read the Constituion who will make up law only to be slapped down at SCOTUS
