Harvard Law Professor Alan Dershowitz just blasted the AG's defiance of Trump

...on CNN a minute ago. He said this was a political act, not a constitutional or lawful action. He said it is a shame that she is trying to use the constitution to justify a political statement in an attempt to be a hero. He said parts of the Trump order may very well be unconstitutional or unlawful but to defy the entire order instead of stating which parts are unconstitutional shows that this is a political move.
He also called out his former colleague Elizabeth Warren for intentionally misstating the constitution by referring to the "no religious test" clause while forgetting to include that that phrase only refers to eligibility for elected office, not immigration policy.
I love his quote where he said that "this nation has a habit of saying anything they don't like is unconstitutional."
Another great point he made is that the first amendment applies to Congress, not the president. It says "congress shall make no law" for a reason.

And Alan Dershowitz is certainly no Republican or Trump supporter. He said that Trump's order is horrible policy for the nation, but he is sick of people trying to use "but this is unconstitutional" as a catch all phrase for anything that they don't like. That is not how constitutions work.

Press Secretary absolutely RIPPED the media this morning in his weekly address. He said very bluntly it is a PRIVILEGE and not a right to come here. Then he asked the media which part of that they were having a problem understanding. It was eerily silent in the press room for about fifteen seconds. Which is a long, long time for those people to shut up.

Exactly. Protest all you want and say that this is horrible policy, un-American, etc, but quit saying it is unconstitutional. A Syrian citizen living in Syria has absolutely zero protections under our constitution. None. Period.

I don't think he is MAGA at all. But he will call out liberal and conservative idiots who scream about the constitution and yet know virtually nothing about it. The constitution gives a very broad amount of power to the president. You have to remember that the whole reason we have a constitution is because of how weak the Articles of Confederation were. The founders realized we had to have an executive branch with real powers. Trump is simply using them.

I disagree with Mr. Dershowitz on one point. The First Amendment applies to the states through the 14th amendment.

Correct. I misstated him. I will edit. It does not "only" apply to Congress as I originally wrote. But it does not apply to presidential orders.

He is on again. He flat out said that her job is to enforce the law and the orders of the president "unless it is clearly unconstitutional or clearly violates statute" and this defiance does not fall in that category. He then really blasted her for saying that it is her obligation "to stand up for what is right." No.....your job is to enforce the law, not make social or political statements.
I know many of you hate CNN but Dershowitz is kicking arse and taking names on these ill informed so called experts.

Unlike a certain former president who was touted by the leftist media as a constitutional genius; Dershowitz actually does seem to know a little bit about the Constitution.

He just shouted down some liberal lawyer as if she was his student. He told her "no you are flat out wrong." The guy is the premier constitutional law professor in the nation. I would listen to what he is saying.
