DD has the estimate at 43 now. That pretty much seals it. I could see the Dems pushing close to 40 for some drama and then let a couple flip to "Yes" but 3 or 4 flipping seems unlikely.

ETA: the only thing that makes sense is that the Dems are betting on the Repubs folding on this

There was some scuttlebutt last week that Republicans didn't have the votes for the nuclear option. Doubt that is the case, or at the least they didn't have enough on the record as being committed to it. We shall see.

So who replaces RBG? Ted Cruz or Mike Lee? I guess the other can always replace Kennedy.

So does this mean any further appointments also get nuked in? If this guy can't get by the Dims on his record then I sure as hell seeing any later appointments as a tough hill to climb without the nuke.
