a warrant... Glad I don't live in Illinois.

quote:

Yet while the average person’s rights seem to shrink under a proposal that is just as antiquated as the 1961 law it tries to replace — a law struck down as unconstitutional by the state Supreme Court — the power of government to operate without overview seems to grow.

This little nugget is also included in this legislation: With permission of a state’s attorney, not a judge, police could legally eavesdrop on individuals for up to 24 hours without a warrant while investigating such serious crimes as murder, sexual assault or kidnapping.

The unspoken danger in that is clear: Expanding police authority to listen in on conversations without a warrant — previously only allowed when there was a “dangerous situation” — is a power more likely to grow rather than be curtailed.

It was passed by both houses in Illinois, and sits on the governors desk. Chances are he signs it.

does proposal = bill? Because it's a Bill right now and once a bill is signed........It's a law.

A proposal is a draft before it is a bill.

As a cop, I am by no means in favor of this. I jealously guard my constitutional rights. I don't need Big Brother holding more authority. If someone wants to waste battery power recording me in public, film away.*

*Please, just don't take away my ability to shoot dogs. That's all I ask.

No way that passes Constitutional muster.

Either provision.

The last one got struck down too. They'll just pass a new one until it gets struck down again.... Years down the road. In the mean time it will be the law in Illinois. I don't think our govt was set up to operate this way.

Personally, I'm not extremely opposed to the cops listening in to me if they believe I am committing a crime. I hope that I never find myself in that sort of situation, but if I do, I hope that still have enough sense to use more covert means of communication anyway. So, like I always say, if you're not hiding anything, whats the big deal?

Now the idea of it being illegal to film cops is a pile of shite. If they are following the law, then the recording should only show legal activities, right? Should be able to film them for at least 24 hours without a permit, right?

It's pretty easy and quick to get a judge to sign of on a wiretap if there is probable cause. If they don't even have that what reason would they really have to eavesdrop?

Should be able to record them anytime for as long as we would like. They are super-sensitive to cameras but they will just have to get used to it.
