A U.S. Navy sailor from Washington State is currently serving on a submarine thousands of miles away in the Pacific Ocean, but a judge has ordered him into an impossible custody scenario: Appear in a Michigan courtroom Monday or risk losing custody of his 6-year-old daughter. Navy submariner Matthew Hindes was given permanent custody of his daughter Kaylee in 2010, after she was reportedly removed from the home of his ex-wife, Angela, by child protective services. But now a judge has ordered him to appear in court Monday, or risk losing his daughter to his ex-wife in addition to a bench warrant being issued for his arrest, ABC News reports.

Depends on the ex-wife. I'm guessing she's pretty terrible. But having a daughter kept from her mother and staying solely with a stepmother is a tough call if she's made a turnaround or is otherwise fit.

Clearly not making some other arrangement is ridiculous, and threatening a bench warrant is downright moronic.

So the sailor is domiciled in Washington. The kid is domiciled and currently in Washington. The dipshit ex wife is in Michigan. The dumbass judge is in Michigan. Pretty simple: just keep the kid away from Michigan.

actually I know someone this happened to personally.

Navy sailor was on an aircraft carrier in the MET and ex-spouse back home in US. custody hearing was set and sailor didn't have leave to go back and be there. Sailor asked judge for a continuance because the sailor would be state side in one month and judge denied it. judge did not care what the sailor's excuse was and granted full custody the sailors shite bag spouse.

personally as a vet I think If I ever ran into a judge like that I'd smash their face in.

Hindes’ lawyers argue he should be protected by the Service Members Civil Relief Act, which states courts in custody cases may “grant a stay of proceedings for a minimum period of 90 days to defendants serving their country.”

But the Michigan judge hearing the case, circuit court judge Margaret Noe, disagrees, stating: “If the child is not in the care and custody of the father, the child should be in the care and custody of the mother.”

Hmmm, I wonder where the divorce was filed? I think Michigan has some 100 mile custody rule, but it might not apply if the parents were already that far apart at the time of the divorce.

i mean can she do that in the short term? yes

will hellfire reign down upon her from the appeals court and possibly a federal court? possibly

and if the mother is granted custody and the stepmother doesn't return the child, the state of michican can almost assuredly prosecute the stepmother for kidnapping

The judge is stupid. Several guys I was deployed with had custody of their kids. They worked out stuff for their kids to be taken care of while deployed. Their kids were in direct custody of them while they were overseas. That's some straight BS

you're 100% correct

i really wish more federal and appellate courts sanctioned trial courts for bullshite like this

if her quotes are being reported correctly, this is a spiteful/vengeful ruling. this is not the work of a rational, disinterested judge
