Shock verdict — Mark Witaschek guilty of possessing muzzleloader bullets in D.C

In a surprising twist at the end of a long trial, a District of Columbia judge found Mark Witaschek guilty of “attempted possession of unlawful ammunition” for antique replica muzzleloader bullets.
Judge Robert Morin sentenced Mr. Witaschek to time served, a $50 fine and required him to enroll with the Metropolitan Police Department’s firearm offenders’ registry within 48 hours.

In the afternoon on Wednesday, Judge Morin shook the plastic shell and tried to listen to something inside. He said he could not hear any gunpowder. He then asked the lawyers to open the shell to see if there was powder inside.
(This seemed like a bizarre request since the lack of primer — not gunpowder — would be relevant to the interoperability of the misfired shell.)
Assistant Attorney General Peter Saba said that the government wanted to open the shell but that, “It is dangerous to do outside a lab.”
The prosecutors and police officers left the courtroom to try to find a lab that was open in the afternoon to bring the judge to cut the plastic off the section that holds the pellets.
When that proved not possible in the same day, the judge decided to just rule on the bullets.
The 25 conical-shaped, .45 caliber bullets, made by Knight out of lead and copper, sat on the judge’s desk. They do not have primer or gunpowder so cannot be propelled. The matching .50 caliber plastic sabots were also in the box.
There was much debate over whether the bullets were legal since D.C. residents are allowed to buy antique replica firearms without registering.

So much fail in DC, and we wonder why they frick up the country so bad...

If it doesn't have a primer, you could just shake the powder out, right?
Who in their right mind would try to seat a primer in a shell already containing gunpowder? Is life not exciting enough?

How many arguments on the left have to do with "The founders were talking about muskets when the 2nd was written, not modern guns..."

You would think they would have at least SOME knowledge of the object they're prosecuting the guy for.

No shite. At least google it 15 minutes before you get there.

All the while, police departments across the country are buying military equipment, ar-15s, body armor, etc.
People may find this humorous, I don't.

Please tell me this isn't real life.

You know, I was driving home a few months ago and saw this puppy sitting in the police station parking lot...
Seriously, there were regular police cars in the lot, then BOOM, this thing. Why does a metropolitan police department need this vehicle?

Meanwhile, in California
Anti-Gun State Senator charged with Gun Running

California state Senator Leland Yee has been charged with, in addition to bribery and public corruption…yes…gun running. Specifically conspiring with known organized crime lord Kwok Cheung “Shrimp Boy” Chow to illegally import firearms and sell them without a license
quote:
The affidavit charges that the $2 million worth of weapons to have been secreted into the country from the Philippines included rocket launchers and machine guns, some of which Yee himself had fired while on Mindanao. A portion of the weapons Yee conspired to bring into the U.S. through New Jersey were to have been forwarded on to North Africa via Sicily

Mr. Witaschek and his wife moved to Virginia after his arrest in 2012. On the way out of the courtroom after his conviction, Mr. Witaschek said that the court clerk came up to him privately and said, “I’m glad you don’t live in D.C. anymore. These people are nuts about guns.”
What a messed up story. I hope the appeal process works in his favor.

Surely there will be an appeal. Some attorney would be willing to take this on.

In a parish with a population of 10k and considered a rural area a sheriff department recently got a MRAP from the federal govt for 15,000 dollars. With the exception of maybe a few major roads this vehicle cant even travel most of the roads in the parish.
I dont know why the feds are spreading these things all over the country but I do know that most local agencies just like buying useless "toys" and my understanding there is a year+ waiting list to get one of these on the local level.

Judge's rationale: if there is a question about it, it must be illegal.

The glut of blunderbusses in DC must be a frightening thing for the govt. to fathom reasonably.

Meanwhile here in Ms, I just heard that a local church is having a raffle for 5 AR 15s. Interesting times we live in indeed

What do you call it when supposedly intelligent people are fully committed to idiotic positions?
