56,000 emails, with no connection to terror collected by NSA

quote:

WASHINGTON (AP) — The National Security Agency declassified three secret U.S. court opinions Wednesday showing how it scooped up as many as 56,000 emails and other communications by Americans with no connection to terrorism annually over three years, how it revealed the error to the court and changed how it gathered Internet communications.

Director of National Intelligence James Clapper authorized the release Wednesday

While the NSA is allowed to keep the metadata — the address or phone number and the duration, but not the content, of the communication — of Americans for up to five years, the court ruled that when it gathered up such large packets of information, they included actual emails between American citizens, it violated the Constitution's ban against unauthorized search and seizure.

quote:

The NSA disclosed that it gathers some 250 million internet communications each year, with some 9 percent from these "upstream" channels, amounting to between 20 million to 25 million emails a year. The agency used statistical analysis to estimate that of those, possibly as many as 56,000 Internet communications collected were sent by Americans or persons in the U.S. with no connection to terrorism

Gotcha. And no, no idea at all. But the secrecy protects us, right?

I have a greater responsibility than you can possibly fathom. You weep for opened emails and you curse the NSA. You have that luxury. You have the luxury of not knowing what I know, that our lack of transparency and accountability, while tragic, probably saved lives. And my existence, while grotesque and incomprehensible to you, saves lives! You don't want the truth, because deep down in places you don't talk about at parties, you want me in your phone records. You need me in those phone records. We use words like "metadata", "database queries", "oversight". We use these words as the backbone of a life spent defending something. You use them as a punchline! I have neither the time nor the inclination to explain myself to a man who rises and sleeps under the blanket of the very freedom that I provide, and then questions the manner in which I provide it! I would rather you just said "thank you", and went on your way. Otherwise, I suggest you pick up a laptop, and man a workstation. Either way, I don't give a damn what you think you're entitled to!

Yea. I'm feeling REALKY safe with the secret courts, unconfirmed "evidence" that allows these guys to get warrants from the secret courts, etc.

Can we hit the reset button? I'll take my chances being free.

FWIW, the much more important point here is that the court had no clue about the truth of the violating collections. And it had no possible way of getting one, until the NSA voluntarily revealed them.

No credible oversight mechanism.

It remains quite easy as hell for them to withhold nearly whatever they decide to, even from the secret court, and the oversight committee, let alone from the public.

No domestic spying program to see here.

Makes you truly wonder what eles they have been up to, considering there appears to be nearly zero oversight and accountability.

How would you suggest that oversight be improved?

don't think it's possible without destroying the program's effectiveness (although that has not been convincingly shown anyway)

risk (and now demonstrated repeated occurrence) of 4th Amndmt violations means program in anything close to current form fails cost-benefit easily

What 4th Amendment violations are you referring to with the programs as currently situated (at least to the best of everyone's knowledge)?

What risk are you referring to?

Are the benefits of the system even fully recognizable, much less appreciated?

I'm long on the questions here because I think this is a discussion worth having.
