DOJ invoked Espionage Act in calling Fox News reporter criminal 'co-conspirator

This really is scary. Holder should be fired, then prosecuted. Total abuse of power at the behest of Obama.

quote:

The Justice Department did more than seize a Fox News reporter's emails while suggesting he was a criminal "co-conspirator" in a leak case -- it did so under one of the most serious wartime laws in America, the Espionage Act.

quote:

It's the same law used by the Nixon administration to go after The New York Times and Daniel Ellsberg over the leak of the Pentagon Papers. It's the law used to charge the Rosenbergs, American communists, for allegedly passing secret information to the Soviet Union -- they were executed for the offense in 1953.

quote:

One Washington attorney, who represents two defendants recently charged under that World War I-era law, told FoxNews.com that the decision by the Justice Department to invoke it in the current case is "beyond chilling" -- and could set a dangerous precedent for going after reporters.

quote:

In the case involving Fox News, a government adviser was accused of leaking information after a 2009 story by Fox News' James Rosen was published online which said North Korea planned to respond to looming U.N. sanctions with another nuclear test.

Court documents, which were filed in 2011 and surfaced earlier this week, show the Justice Department made a series of claims against Rosen in the course of seeking a search warrant for his personal emails.

In an affidavit, FBI agent Reginald B. Reyes claimed there's evidence the Fox News correspondent broke the law, "at the very least, either as an aider, abettor and/or co-conspirator."

That line cited a section of the U.S. Code that falls under the Espionage Act -- pertaining to the unauthorized gathering and transmitting of defense information. The section carries with it a sentence of up to 10 years in prison.

quote:

The administration has come under criticism before for using the Espionage Act to prosecute leakers and whistle-blowers. Under the Obama administration, federal prosecutors have used the act six times.

and i'm sure the liberals will come here to defend Holder or Obama. It's just plain shameful. Willing to give up your basic freedoms to appease your slave master.

Even Chuck Todd acknowledges the criminality of it all.

quote:

NBC’s chief White House correspondent Chuck Todd said on Wednesday that the Obama Administration’s seizure of reporters’ emails and phone records is evidence that “they want to criminalize journalism.”

Todd, who made his comments on MSNBC's Morning Joe, said that if President George Bush and Dick Cheney had engaged in spying on and seizing journalists’ private emails and phone records, “candidate Obama would be unloading.” Todd said individuals he now talks to are “quite uncomfortable having conversations on the phone. Maybe that’s the intent.”

The NBC reporter added: “you can't look at this and see it as anything other than an attempt to basically scare anybody from ever leaking anything ever again.”

Todd is not alone in condemning Obama’s unprecedented intrusion into press freedoms. Today, the New York Times blasted the Obama Administration, as did progressive Washington Post columnist Dana Milbank who said “the administration’s actions shatter the president’s credibility.”

Might have shattered Obama's credibility, except who believes he had any to start with?

My question is did Holder recuse himself from the Rosen case as he claimed to have done with AP reporters' case?

Boy, this Obama administration couldn't handle just one news agency asking tough questions
Quite sad, when one really thinks about all that

Obama's Administration has had a pretty smooth ride & still handled it all wrong. You find out what you've got when the bullets starting flying. This Obama administration isn't someone I'd want in my foxhole when things heat up. Plus, they'd probably blame me for them running away scared.

No doubt...they will give unprecedented access to movie directors and producers to the behind the scenes components of our high end spec ops to make a movie, but dammit, you better not be asking for information to break on story on North Korea.

It really is funny when you see Rex and VB circling the wagon about the importance of tamping down leaks, when this administration has been a purposeful sieve of information when it benefits them.

When called out on that defense, the next illogical defense is that, well, Bush did it too.

That seems inapplicable now as well. Don't recall Bush using the Espionage Act to go after any reporters...or as this case may be MSNBC reporters.

I'm no liberal and I am quite pleased the DOJ is looking in to this guy Rosen.

Excellent law. Ellsberg, Rosenberg and now this guy Rosen. Where ethnic interests trump the national security interests of their own country.

BHO ought to have the DOJ go after some of the other spymasters slinking around Washington in various think-tanks and war-mongering ethnic interest groups. All of these scandals all of the sudden are real convenient in light of recent developments in Syria and the RED LINE Vladimir Putin established there.

First thing you need to know about my post. frick Fox news and their lie spreading bull shite.

Second thing, frick the obama administration for this. The people deserve to know any information we want about what our government is doing. We elect them and pay for them so they should be doing our bidding. This is a shame, doing good investigative journalism isn't a crime it's a public service. This needs to be shot down quick fast and in a hurry or journalism in this country is going to get even worse than the current cluster frick of biased reporting from one side or the other.
