Depends on where the sponsorship money comes from. I've got a guess on which side will have more sponsors.

Other states use a multiplier for private schools. Like each student is counted as 1.3 students. So a school with 300 kids is classified as if they have 390 kids. It evens things out a little more.

According to an article in The Advocate today, there will be a meeting at PVB this wk to discuss..not make plans...the ramifications of this new rule. As well, there will be similar meetings around the state amongst other select schools. If the Legislature does not step in, the possiblity of the select schools forming their own association mite well happen.

I guess that works if schools are recruiting athletes. A school with an inordinate percentage of athletes would be more accurately rated, but it would really penalize once again the schools who act appropriately.

It would be great if multipliers were applied based on percentage of athletes. Start with an average of all public schools. For select enrollment schools, Increase multiplier by percentage of athletes above that. A 2A school with 100+ football players such as JC would be elevated in class, while a similar sized school with 40 players would be still 2A.

with this playoff split, schools like Livonia, Port Allen, and East Fel that usually hit private school roadblocks in the playoffs could get a state ring very soon.

The Louisiana High School Athletic Association (LHSAA) announced today that the 19th Judicial District Court has declared the organization a private entity according to a Nov. 28, ruling issued by Judge Todd Hernandez. A motion against the State of Louisiana was heard on Aug. 29, asking for a summary judgment in the matter.

The LHSAA was formed in 1920 and was established as a Louisiana non-profit corporation in 1988. The LHSAA consists of public and non-public Louisiana high schools that voluntarily apply for membership and are accepted in accordance with the corporation’s articles of incorporation, its constitution and by-laws.

Based on the ruling issued, in the eyes of the 19th Judicial District Court, the LHSAA is a private entity when it comes to making and enforcing the association’s rules. According to the court, Article 3, Section 12 of the Louisiana Constitution prohibits the legislature from passing any law that amends, changes, or explains the charters of any private corporation. The Court also held that the Legislature’s actions violated LHSAA’s constitutional right to equal protection and due process of law. Therefore, state laws enacted in past years have been declared unconstitutional by the ruling. One of the laws which the Court struck down was a recent law stating that the definition of the word “family” as used in LHSAA rules would not include grandfathers and grandmothers. Other laws specifically cited in the judgment were Act 465 of 1997 and Act 691 of 2010, making changes in the LHSAA rule on home school student eligibility. The ruling is expected to be appealed and eventually heard by the Louisiana Supreme Court.

Once affirmation is received, the LHSAA’s Executive Committee will make decisions regarding student athletes covered by Act 465 and the home school students. The primary purpose in filing the lawsuit was to establish that LHSAA, as a private organization, has the legal right to make its own rules without political interference. The LHSAA had by-laws that allowed home school students to participate at it member schools prior to the state law being passed and has no reason not to continue to allow home school students and those affected by Act 465 to be eligible to participate in interscholastic athletics at its member schools in accordance with its rules.

The Nov. 28 ruling also declared the LHSAA a quasi-public agency for the limited purpose of specific state statutes regarding the Louisiana Legislative Auditor.

If it is a private organization and not a public one, then there should be little issue with member schools deciding to say "Screw you, I'm forming my own athletic association, with hookers, and blackjack!"

this is the way it was explained to me about what may happen:

Individual politicians will make noise about the LHSAA based on complaints by constituents

Once the details of the proposed playoff is public, schools will file suit

the courts will decide the law suits, the politicians will use the outcome of the lawsuits and the negative publicity to revisit the Legislative oversight issue and then it is on like Donkey Kong

I seriously doubt the court will make an exception to the laws protecting private corporations from legislative meddling over this.

What's more likely to happen is the private schools banding together and either refusing to schedule any public school who voted for this OR striking out on their own.

Just the negative publicity alone is bad for the LHSAA Exec Comm

That is the consensus amongst people I have talked to

And the privates will form their own association to get away from the state oversight

And some school boards will try to get their schools in the new private association to get away from state oversight as well. That will not be an easy thing to do

If this happens the state run LHSAA and the private LHSAA will look remarkably like a north/south split

If/once the select schools do form their own association, the first order of business will be to decide whether they will continue to support the non select schools by playing them as non district members. And as those games' gates are normally split, that means the non select schools will be losing a huge amount of income, income that is not near enough now to cover most school's athletic expenses. I have seen a select school game vs a non select school, and on one side there were 3-4-5K + fans; on the other side, mabe 20-30. The $ issue will soon bring everyone back to their senses.

I was curious if that would happen or not, Orleans Parish would be with the select schools, it would be interesting to see what Jefferson Parish does.

The state will never have oversight. The principals have the right to join whatever organization they deem fit. The public principals, 206 of them right now, are staying with the LHSAA. If the select schools are offended, they have the right to leave.

Ok you do relize that several public schools will be in select group as well.
