They stay there. They were breaking the law when it was illegal, correct?

How many times would that excuse be abused?

"Oh, he was just acting like he was on marijuana."

Yea, it is risky, but that is why I would require video evidence of the impairment test in order to prosecute for a DUI.

Don't cops already use "smell marijuana" as a probable cause tool? So, of course, there is the opportunity for abuse. You just have to minimize it.

I should have used an asterix, by other states I meant other than states controlled by moronic Bible Belt social conservatives.

But I can see NOLA having coffee shops one day.
We need money and that need trumps all.

You can bet the Feds are going to give these states some serious issues.

With our money too. We'll see how long that lasts. With the deficit we have, I sure as shite don't want my tax revenue being used to bust hippies in Colorado.

So the feds will still only be able to go after the big time producers and providers, but will be essentially powerless to stop the small timers.

Exactly. How much money and manpower would the Feds be wasting if they were going after someone with a joint on them? What is that? A misdemeanor? $25 and court costs?

Then what are the issues in California?

A free for all on licensure. Weed shops operating 20 feet from schools, convicted felons running them, gang and cartel ties, all kinds of shite.

Understood, but how hard is it to believe that a test can't be invented? If there's not already one in production?

Nobody is saying it can't be done. Just that it seems there would need to be a test before they legalize weed.

Kinda interesting that they don't have one yet.

I guess they stay in because they broke the law that was on the books at the time.

I'm simply saying that there SHOULD be a solid, objective, scientific way of determining if someone is presently high in a quick manner before it is legalized.

I agree with your ideal, but is .08 a solid, objective measure of someone's driving ability? All of this stuff is, to some degree, subjective. Many people get pulled over at .08 and don't even get tested for DUI because their driving actions weren't sufficient to give cause.

this will be an interesting development if this passes.

I wonder if legislatures will push to try to release some of the inmates. Every file would have to be gone over with a fine toothed comb

I found it already to be quasi-legal out there, I was in boulder and people were smoking in open view of the police. Street dealers had bags of different strains on them . All said as long as you have under 28 grams, its not a jailable offense.

You are already on the road with potheads and such, the majority of drunk drivers never get stopped. Why would you keep this illegal based on this one stipulation?

Its asinine.
