Advice Lafayette Bankruptcy Attorney

Need some recommendations on a good Bankruptcy Attorney in Lafayette. My wife has not worked in over a year because of medical issues and it looks like she will be out another 6-8 months. We have drained our savings and need to consider all my options.

Honestly, you don't really need a "good" bankruptcy attorney. If you are filing a petition under either Chapter 7 or Chapter 13, the attorney really only does the standard forms. After that, the trustee handles everything.

Almost any bankruptcy attorney these days can tell you within seconds whether you can afford a 13 or need to liquidate under 7.

What is the difference between 13 or 7? This is why I want a good attorney, to explain to me like a 5 year old what the difference is and the ramifications. There are long term consequences with this and I need to make a smart informed decision. What are the typical costs with both bankruptcies?

in LA, to qualify for ch. 7 your income I believe needs to be below $77k or something close to that, what they do is average out your income for the last 6 months.
avoid ch. 13, with ch. 13 you'll be on a repayment plan with the trustee.
ch. 7 wipes out your debt., if you need a good atty here in baton rouge, let me know, i can refer someone to you,

Im not an OT baller so my income is under 77k, and with Ch 7, would i be able to keep my house and vehicles? Both vehicles are in my name and house is in my name.

you can reaffirm your debt to the home and car, you'll sign a reaffirmation agreement, basically stating you agree to keep the home and auto, but continue to pay the monthly payments even if you file bankruptcy

my advice if you do decide to file, make sure you order your self a credit from all 3 credit bureaus from you and your wife. make sure you have all your debts accounted for, open debts to collection debts, make sure the balances are correct, who the correct creditor/collection company is with the correct acct number, dont use acct number from credit bureau, sometimes they are scrambled for security reasons.

It does suck, but your attitude on here seems to tell me you aren't just racking up debt, filing ch 7 every 7 years.

A cheap Ch7 runs about 1k. Depending on the complexity, it may cost more. Good luck.

You may also want to contact a S.S. Disability attorney to see if your wife qualifies. Call Matthew Lane in Lafayette.

Yes, providing payments are up to date. A "reaffirmation" may be acquired.

House and car payments are current, in fact everything is current as of today. I jsut do see how I will keep it up another 6-8 months. Will the attorney handle the reaffirmation part with the house and vehicles are is that something I should contact the lender about?

The lender and your attorney will hash out those details once you have filed.

No doubt. I use to have a negative view of bankruptcy. Then I became a lawyer. Some people need a clean slate. And I do a ton of collection work. Inherit with that work is creditor's rights in BK court. The creditor's know its a possibility the day they give credit.
