A brewer friend brought this bill that just passed to my attention. I can't find much about it online, and I'm sure it's been discussed here before.

Does this bill mean what I think it means?

this might help.

I spoke with the lead counsel for Louisiana ATC today and confirmed that this change to 85.1 only applies to beverages of high alcohol content (liquors and wine) since it is in the chapter dealing with these kinds of beverages. Low alcohol beverages like beer are governed in the following chapter. Quoting from a follow-up email from the lead counsel of the ATC: “SB 64 only applies to liquor wholesalers as R.S. 26:85.1 is for high content only. Louisiana alcoholic beverage law is divided into several chapters; Chapter 1 (which contains 85.1) only applies to high content alcoholic beverages and Chapter 2 (which contains 273C) only applies to low content alcoholic beverages.”

Guess you could challenge the state now that part of the law has been changed. I know there are a few posters with better knowledge about the subject out there.

Thanks man. That's really disappointing to hear. Hopefully someone challenges or something gets done next session. There is really no reason to hamstring potential businesses for things like this, especially in a state like Louisiana.

Thanks for the info. <-- I guess this round was bought from a distributor.

At least it might show a step in the right direction. I have an extremely limited knowledge of how the distribution racket works, but can you use just a small distributor. Say someone who does wine distribution?

It is disappointing. After making as trip to Northern Colorado, and seeing what they have to offer, it sucks to know some of the nano/micro places could never happen down here. It is a whole culture that would fit this area perfectly.

I have heard that now that the law has been passed for wineries, brewers are going to lobby for equal treatment.

Hope you're right. We need enough legislators with the guts to tell Shilling and other distributors to pound sand.

While I'm sure these micro and nano breweries would hurt some business for distributors, I can't imagine that is a lot of their business to begin with. It seems they would stay in business by just distributing the big 3. Of course, how many people would purchase directly from the brewery. These smaller breweries would still need some distribution.

I was just discussing this yesterday.
So the final word is that Brew Pubs are legal or illegal in LA?

Through my limited knowledge, I'm pretty sure a Brew Pub has been legal in Louisiana. I think the issue is a Tap Room where you don't need to have a full functioning restaurant attached.

I could be mistaken though.

Brewpubs have been legal, but lots of red tape and no outside distribution. Only in house sales and you need both licenses.

This new law only applies to wineries & distilleries, but it might mean breweries are next. At a minimum it provides precedent.
