Years ago my mom gave me her old bolt action 410 from when she was about 18...so like 50 years ago or so. It was given to her by a old boyfriend as a Christmas gift...so there is zero paperwork or anything for it. Is there something I need to do to properly have it in my possession and not be considered like a straw purchase? Did they even do paperwork back then?

A straw purchase is when you buy a gun only to sell it after.

Did you purchase it from her so you could give it to someone else?

Good idea...ill report back after with what they say

I thought a straw purchase was if you bought it and gave or sold it to someone else. So its just if you sell it to them?

No idea it just popped in my head if there was anything I needed to do for it

It's only a straw purchase if the person you give it or sell it to isn't legally allowed to own a gun, like a convicted felon. There's no law that I know of that prevents giving a gun as a gift as long as that person can own a gun.

Straw Purchase - When a prohibited person gets another person to purchase a gun on their behalf.

Form 4473 11.a Instructions: You are the actual transferee/buyer if you are purchasing the firearm for yourself or otherwise acquiring the firearm for yourself. You are also the the actual transferee/buyer if you are legitimately purchasing the firearm as a gift for a third party.

If someone gives you a firearm and you are not a prohibited person there is nothing to worry about on your end. It is simply now yours. There is also no registration or paperwork you have to have handy.

The ATF defines this term as follows-

quote:

Straw Purchaser:

A “straw purchaser” is a person who is not the “actual buyer” of the firearm; that is, a person who obtains a firearm for another person. Straw purchases are a primary source of firearms used in crime. If you suspect that a transaction is a straw purchase or there are suspicious circumstances surrounding the potential sale—such as one person picking out the firearm, handling the firearm, and providing the payment for the firearm while another person completes the Form 4473—you should not sell the firearm. Similarly, if one person attempts to purchase a firearm, NICS denies or delays the attempted purchase, and another person with him or her attempts to buy the same firearm, you must not complete this sale.

good idea to keep the serial number model number and description in a safe place with history of how acquired....

can serve as proof of ownership... if it is stolen and found by police.... and you file a police report.
