It would appear so, and possibly at night too. The pic was taken three days before the season opened, at 530 AM. Could have taken that long to track/pose, but if you're hunting out of season you might as well just go full fricknut.

What a dumbass. After the facts are checked out, I hope his license is suspended for a long time. That's assuming he did kill it before the season, and apparently, at night, unless it took him a long damn time to find it.

The picture is photoshopped. Look at his right hand around the antlers, and bow laying on the deer. So I would say no he didnt kill a deer out of season, but yes he photoshopped the shite out of a picture
