WWTOTD: Vehicle hit by rock on the interstate

So I was driving today on I-12 in BR when I heard a loud thump. Look around and there is a brand new chip (a little smaller than a dime) on the passengers side of my windshield. There was a large dump truck in the right lane (I was in the center lane) about 3-4 car lengths ahead. Caught the name of the company and called the number.

Left a voicemail right afterwards. Owner called back about an hour later and said he was sorry but he had no trucks carrying any aggregate and that I was SOL.

Is there really no recourse of action for something like this? What would the OT do?

You are SOL. Those dump truck companies must buy lots of tickets to the police ball.

Did you see the object come out of the truck? Pics? What time was it? That should help make a guess on whether the truck was empty or not. Sounds like the owner just blew you off.

Doesn't Safelite glass repair fix chips for free so they don't spread?

Its just a chip. Get it drilled and filled.

I had a girlfriend years ago that told me that her mother had the same thing happen to her. Basically she just collected a slew of numbers from the back of various dump trucks and called all of them until she found someone who would pay the damage.


Apparently she did this a lot.

Guaranteed the top truck has a sign that they're not responsible for damage. They'll just argue that you were closer than 200 feet. Your fault.

I love the trucks with stickers that tell you stay back 200 or 500 feet with print that isn't visible 200 feet away in many instances.

Or the "not responsible" stickers. Aren't there secure load laws that would make them responsible?

I'm pretty sure a rock on the interstate isn't considered part of his secure load.

Your insurance should cover it. Fixing a crack that small is cheap.

Serious answer since I went through this recently with a $1600 windshield on my 2016 work car. The law in LA is that once the object leaves the truck and touches the ground it becomes a "road hazard" and the truck company isn't liable. If the crack can be covered by a dollar bill, your insurance covers 100% of the crack and chip repair. If it is bigger, your insurance covers replacement MINUS the deductible. In my case $500. I have now had three replacements in 8 months due to a combo of bad luck and I12.

Sucks but that is the way it is. For reference, I had pics of the truck on the first one. It didn't have its cover over the load and the tailgate wasn't properly latched. Their insurance still told me to get fricked.

No. Most trucking companies have insurance that doesn't make them liable anything small that falls from their vehicle, unless something isn't done properly.

I was on I-10 behind a guy whose latch came loose that was carrying loose gravel. shite was like a waterfall. Me and three other people pulled ahead of him and called the cops. They pulled him over and we followed. Had to make a claim on the companies insurance that they were negligible.

TL;dr - unless they were negligible, you are SOL.

Pay an extra 20.00 a year and and get get 0.00 deductible on comp. Every year get a new windshield when your brake tag is due.
