It isn't irrelevant. If it is established that Will Smith was the aggressor that goes a long way towards suggesting that the guy may have had to defend himself. This is pretty plain and simple, and would be clear as day if the alleged aggressor wasn't a former New Orleans Saint.

If you reversed the roles there wouldn't even be a trial. Smith was drinking and driving, ran into Hayes, fled the scene, etc. if it's true that Smith swung at Hayes then I don't see how you could possibly convict him.

He shot the man in his side and back after getting out of his car with a gun. He also shot his wife twice, apparently first.

Even if Smith did swing (and that story told is very fishy with Hayes just taking it and calmly responding), there are still a ton of questions to answer.

Like why a man who feared for his life and wasn't an aggressor was all the way near Smith's car door.

This is a joke. Gonna call up every old saints player to praise Smith and ignore the past when he dragged his wife by the hair. Hayes doesn't have a chance.

the vehicles were right on each other. its like 10-15 feet max between the 2 vehicles front doors with maybe 5-10 feet between their vehicles and the cars parked along the side of the road. Thats not much space for 2 large men along with the others that were on that side of the vehicle.

fuller needs to call up people that witnessed smith drag his wife by the hair to counter this.

all I want to know is what happened that night. all of this is pointless in my eyes. but Im not on the jury either
