The only one that heard what was said between Hayes and Smith is Raquel. If Fuller calls her back to the stand, it could get ugly, but that may be his only chance.
I'm also wondering if Smith actually heard Oneal say that he had a gun, and that's when he said he had one too and started walking back to the car to get his. This would possibly explain why Raquel was calm when she said "we have kids"... She walks back to the car with him, still trying to stop him from taking the gun out. As he leans in, Hayes fires two shots and accidentally hits Raquel, causing Will to turn and look back. Hayes thinks Will has gun, puts one in his left side, Will turns back again to grab gun and Hayes empties the clip.

There was testimony that the only one who mentioned a gun was Hayes.
I believe that Racquel and Will walked back to the driver's door of the Benz. Will's back was to the open door and Racquel was standing near him further away from the door. Hayes followed them and shot her first then Will in his side. I think that Will seeing his wife get shot and then being shot turned toward his car and Hayes shot him in the back there. That would explain why his left arm was extended over the wheel/dashboard and his feet were pointing toward the passenger side of the car... why his body was half in and half out of the car.
There is testimony that the bullet trajectory of the left side wound occurred when Will was standing straight up and that the other bullets went in at an angle.

No way no how did Hayes intentionally shoot Raquel. I'll go to my grave with that.

People don't typically take conjecture to the grave.
I do agree that it is doubtful that he shot her on purpose though.
In my CCL class the instructor said that, in a lot of instances, untrained people tended to shoot while raising the gun up to acquire their target.

There is absolutely nothing to suggest that he had anything against her. She said she was doing nothing but trying to diffuse the situation. Not one witness has testified that Hayes was aggressive. Clear enough?

That being said, I don't think intent even matters on attempted murder, so he probably gets that too. Or maybe attempted manslaughter?

I don't believe for a minute that Racquel was shot unintentionally, but I guess we'll find out if/when Hayes testifies why/how she was shot.
Racquel's knees are hardly even with Will's upper body (where all of his wounds are...) and Hayes would have to have been shooting downward to hit her around the knees. If you look at pictures, she was a lot shorter than Will and only came up to Will's shoulder, as shown in this picture: R & W

So answer this. After the altercation, hands fighting, the yapping back and forth, why did Hayes THEN decide to shoot Smith after he was leaving the scene?
Common sense would say if the dude was just so mad that he wanted to jump out the hummer and kill someone, seems to me he waited a little long right? That tells me that we don't have the entire story. I believe Cardell feared for his life due to Smith's actions.
