Hayes had a gun when he exited the vehicle. That's a fact. Now what's being debated is whether or not hayes exited his hummer with the weapon visible or was it concealed.

There Is still a female I know that is in town being put up at a title from Atlanta. She moved shortly after the incident and did not like the attention she received AT ALL.
It's weird because she is a witness for the defense but from my perspective you would have thought the ADA would have called her.
I do know that she was first contacted and interviewed by the defense and didn't really pay attention and realize that was who was interviewing her.... she is a female though, so.

yeah... the prosecution called a woman who was living in NOLA at the time of the murder who's now living in ATL
was with Ross the night of the murder at the Half Moon
didn't really get a lot from her testimony that I remember

It has not been established as fact by the prosecution.
Not one witness that the prosecution called said that they saw Hayes with a gun much less exited his vehicle with a gun.
Racquel Smith testified that she was between the two.
Another witness said that they were hand fighting each other.
If Hayes has a gun at that point it must have been hidden well.
The only thing that we know is there us a 911 tape with Someone saying that they had a gun in the background. It is supposedly Hayes. The prosecution never pushed the issue and the defense never questioned it.
I don't know much about Fuller as an attorney. I do know a little about New Orleans DA's. IMO. The Fa did not present a very strong case but wouldn't say it was a week case. The defense has many openings to attack NOPD credibility, witnesses, and self defense and some rated off with a shite show. Basically the equivalent of showing up to gun fight with a water balloon.

The defense has only presented a few witnesses and all were very week. iMO

Yes the different witnesses all have pieces and parts... but putting it all together with the physical evidence... Hayes had no reason to shoot Will Smith and should be punished as such
ETA: the private investigator... the defense's #1 called witness... basically destroyed the defense's evidence tampering claims

they said she was originally from France
didn't seem to have a whole heck of a lot of information... nothing that really stood out to me that I can recall

Evidence shows CH didn't get out of the hummer wanting or planning on killing anyone. I think Hayes takes the stand and says WS made him fear for his life and that he had no intentions on shooting anyone until it was escalated. There is no evidence saying that WS didn't escalate it during the heightened ordeal caused by Will's party who were all lacking cognitive ability due to alcohol.

there is a reason that all of the lawyers acting as independent analysts on this say Hayes MUST testify... esp after the PI
