Cardell Hayes: Not guilty of criminal damage. Guilty of attempted manslaughter. Guilty of manslaughter.

Didn't realize this at the time but one of my buddies is being called as a witness. He was outside at the time by Half moon. I talked to him yesterday for lunch. It's going to be interesting how this plays out.

Yes. Judge just granted the State's motion to exclude Cardell Hayes' statement to the police post-arrest, and granted the state's motion to introduce John Fuller's media statements to the jury.

I would think that the statement from the accused would be admissible.

Not really, if you invoke the fifth amendment at trial and choose not to testify, you also don't get to introduce recorded and/or out-of-court statements. That would allow you to basically testify to the jury without being cross examined.

It was months ago, but I imagine they're referring to the stuff about suggesting there was a video of a gun being planted, a video of Will Smith holding a gun, etc.

Right, that's what sequestration in the context of a witness means. Raquel Smith is the only witness who will be allowed to remain in the courtroom for the entirety of the proceedings.

I'm calling this case now--the DAs office will lose as the evidence and facts are very flimsy along coupled with the stand your ground law.
