It is definitely still a thing. Perhaps less so now because of the affordability and accessibility of services.
I used to torrent everything 15 years ago. I still use it for some stuff but now I have Spotify, Netflix, Amazon, and a relatively affordable Adobe subscription.

Seems like I hear about people "torrenting" things, but it also sees like streaming things on youtube or things like spotify or other legitimate services have made it easier to get content so that actually downloading the content just isn't worth it comparatively for most people.

If the Kodi app uses p2p they yes, it's illegal. If app uses links to streams only...it is not. The most popular apps like covenant and the former exodus who h nearly 80% of people with Lodi use are apps the link to streams.

Copywrite infringement whether hosting or consuming is still pirating.
The host of the copyrightedmedia is obviously risking punishment much harsher than those who are consuming the media.
