Just frustrating. Now they will have 12 less customers (and I know that really won't hurt them with the thousands upon thousands of people that visit them annually)

Reimbursment for the tow won't happen. But at least issue an apology and state that the restaurant was in the wrong. Guess they must have too much pride....

This is the way to do it (if you don't mind being a dick). Call the tow company, say your car was illegally towed and you want it back for free. When they refuse, tell them your calling the cops to report it as stolen. If they still refuse then, actually call the cops (call the non-emergency number though, not 911)

I did a lot of research on this subject which by law is referred to Non-consensual Towing a few yrs ago when my daughter ran afoul of Riverside towing in BTR. In a nutshell for this towing company to have towed the vehicle they had to have a contract with the owner of the property. They just cannot drive onto private property and haul away cars. They have to have the permission of the property owner/operator to do so.

Therefore Agave is lying if they say they have no claim in the case. You should take your towing bill to them for re-imbursement or demand your restaurant bill be refunded. If they refuse then report them to the BBB. The BBB will post the complaint and it will stay there until the owner resolves it. Another option is to somehow publicly communicate that this business has been known to tow the cars of its own patrons.

With regard to your statement of unlawful towing you are probably incorrect and you have virtually no recourse on this avenue unless they violated the law at which you can report them to the State AG office. From what is sounds they did not cross the legal line.

My wife and I sat in the bar downtown for 10 minutes one day. We were both off work and went to go drink and eat. Never talked to anyone. We left and have never gone back.

Talk shite about them on yelp and any local message boards you can find.

The Balbeisi family is shady as frick anyway. I scratched all their restaurants years ago after watching the younger ones act the arse around town. The oldest, Nidal, seems cool but EZ is a total douche

The owner does not have to resolve the issue, he just has to address the complaint.
For this reason, the BBB is useless in matters such as these.

Nothing ever comes out of this. About 5 years ago Riverside Towing came under major heat and nothing.... absolutely nothing changed.

Considered taking my story to Yelp but that won't do any good. 1 bad review isn't going to hurt them. Plus they have only 31 reviews at their E Vermilion location with an average 2.5 stars. Guess that's saying something, huh?
