you take the time to read on down into the story it says the guy fired when one of his windows broke in.

quote:
Lovell initially tried to communicate with the teenager knocking on his door, prosecutors said. But then he snapped.

“When a pane of glass broke, the suspect fired a single shot, striking the victim,” according to the statement from the Hampden DA’s office

I'd think someone was breaking in as well at that point

Laws up there are different. You can't just shoot a someone breaking and entering. They have to pose a threat to your life, not just your property. By their standards, this was murder.

Seems as if the OP left an important part out of the description...the whole thing about breaking in and all

Was the kid ever even in the house though? If not, it is vandalism. If he's in the house, it's breaking and entering.

Again, laws up there don't allow you to just fire on someone like you cold in Louisiana.

You're not supposed to shoot through doors.

've had a random stranger come into my house at 3 am in the morning.. Was so weird. He looked at me then just crashed on my couch.. He had the wrong house. He was clearly intoxicated.. At first I was shocked but I quickly could tell he was no threat... So I went next door to where he meant to go and got his friends to come get him. He kept saying how he could have been shot,

He had left his truck parked in the middle of the road door open, keys, and phone in it I believe.. I'll never forget how weird it was initially seeing a guy I never knew just come in and go straight for the couch

He's right he could have been. If just simply being intoxicated makes him do that, maybe he needs to not drink. I'm sure he realizes how stupid it would have been if he did get shot being a drunk idiot.

I think everyone has walked into the wrong house / condo at some point during their high school or college years.

Ughhhh.....no.

My parent taught me to knock and not just barge into somebody's place. Think they called it manners?

I've knocked on the wrong door before, but that's the whole point behind knocking.

This goes back to the topic yesterday about gun ownership and whether or not it is a net benefit for every individual.

I've got little doubt that there are gun owners who want an excuse to use one to defend themselves. Not saying that was the case here, but there are people who are jealous of this guy's opportunity.

Not really. Those boys were walking away and the guy came out and shot the exchange student.
The shooter's defense might be the worst ever. "a man just like the jury members' neighbors, a man who "liked sugar in his grits" .

Other people said something similar in the thread yesterday. Are you really going to deny that there are gun owners (think open carry types) who would love to have a "justifiable" reason to shoot someone?

The Joe Horn case in Texas is a great example.

Is it though?

quote:

On the 911 tape, he is heard confronting the suspects, saying, "Move, and you're dead",[3] immediately followed by the sound of a shotgun blast, followed by two more.[4] Following the shootings Mr. Horn told the 911 operator, "They came in the front yard with me, man, I had no choice!"[5]

Pasadena police confirmed that the two men were shot after they ventured into Horn's front yard

Massachusetts is so retarded. It sounds like I could strap a go pro to my head, kick in someone's door, loudly proclaim I do not intend to harm anybody, then start grabbing shite and either get out without incident, or press charges against the homeowner if he shoots me.

fricking liberals.

How does someone go about "accidentally" knocking so hard the glass on the window breaks? I lived in the fraternity house, so I've seen drunk people break things, but it's never been "on accident". It still takes way more force than reasonable even when you're drunk

Yes, it is. He had no choice after he ignored the dispatcher's request to stay inside and went out to confront the burglars himself.

Look, I'm not going to excuse the teenager or the burglars, and I'm not really trying to debate the legality of the shooting because that is settled. However, I do take issue when deadly force is used and a threat to life is not imminent and/or is reasonably avoidable.

Based off the facts, I don't agree.

I hope my neighbors protect my property as well and Mr. Horn did.

Oh, we know you take issue.
