re: Small Claims He said/She said legal question

Yeah. Never got a notice. The development is new and the HOA is still the builder who bought all the land. It will turn over soon when full, so really the HOA one company, not my neighbors.

I'm calling him Monday, but it just pisses me off. I should have watched to see if the check cleared, but I think it's ridiculous.

A guy at my firm represents lots of HOA's.

Call and talk to the attorney (or attorney assistant). Explain that you sent a check, but that they never cashed it. Explain that you did not receive any notices, but you will pay the regular amount that day.

They will take that most likely. Attorney are on retainer for the HOA's so he has been paid for the time already. Appearing in court will be a waste of time, so they will let you pay to avoid this.

Do you have an HOA agreement that you signed when you built the home?

I don't think it the check giver's responsibility to make sure the receiver cashes it in some timely fashion.
however, I find it very strange that the hoa has involved an attorney before a quick letter to you first. id assume this attorney is the builder /developer 's personal attorney that he uses all the time. probably just used his letterhead in the threatening tone.

Thanks. Yes we signed a HOA agreement but it never specified penalties, etc. I may pull the full file tomorrow to confirm. This is the third year we've paid, no big deal before.

Negative. I live in a house (in a neighborhood) that I own. The difference is, material things aren't my top priorities, and I don't have to live in more house than my family needs just so I have the biggest thing I could get a mortgage approved for. If I decide to buy something else, it will include a few acres where I can pee off my front porch and there be no chance of anyone knowing. Not everyone prefers the city life.

Do you people actually believe this stuff? You must live in some shitty areas.

I'm sure y'all are wrapped up with HOA's up there aren't you. No? It must be nothing but trailer parks then. Yep, that settles it, nothing but trailers and igloos in AK. Is there a minimum square footage regulations in gated igloo communities?

It amazes me how stupid some people can be.

They like their houses to look like the neighbors. But the status of a subdivision.

The assumption that you have to live in with an HOA or a shitty neighborhood is so laughable. I guess if you live somewhere that property is of such a low value, it may make sense. I don't have that problem.

I would rather a trailer park I think. At least you would have entertainment.

There is one a couple miles down the road, doesn't affect my property value. You're right though, probably more colorful and entertaining than the HOA biddies.
