That is the point though - there are no distinctions in the law.
I'm not going to lose one ounce of sleep that a thief with an AK-47 was shot. My original post was about whether or not it was legal, not whether or not it was morally wrong in this case.
Since then I'm arguing against how liberal the law is in Texas. You could shoot a 12 year old for taking muscadines from your neighbors tree after sunset. That is a crazy hypothetical, yet it is legal under the law.

What a shitty law
The "during the nighttime" only modifies "theft"; deadly force is allowed for burglary, robbery, aggravated robbery regardless of the time of day.
Aggravated robbery is theft while using/exhibiting a deadly weapon; I assume the nighttime exception is because at night it might be difficult to see the weapon during the theft.

Okay, I agree with you. However, how many times has this happened? It is not a simple task in writing a law that specific. Most people, I think would agree, that government should not regulate us to that specific of detail. I trust in my fellow citizens to have some common sense when apply the law.
Also, that twelve year old should be taught by the parents whether or not that is okay given the neighbor, their relationship, is it a stranger, etc. too many x factors in this hypothetical to even argue it since I am unaware of something like that ever happening.
