Question about police underage liquor buying schemes

Is the act of attempting to buy liquor while underage illegal? I witnessed one of these and the clerk was arrested for failing to check ID.

Had the clerk ID'd this person and then denied the sale could she have pressed charges against both the underage drinker and the police?

I think in Georgia, it is illegal for a business to refuse an id if it appaears legitimate.

The ATC does not try to trick the cashier. Half the time they are around 12-15 years of age and look as if they are 12-15. Plus they send an agent in the store to witness the transaction.

So if I'm following your logic, that would make just about any undercover operation illegal by your thought process? Drug bust set ups, prostitution stings etc...

If it is illegal to attempt to purchase it is a crime. Entrapment comes to mind as far as the cops go. The underage kid I saw was about 6 ft 3 or so and looked older than he was.

Oh my bad I misunderstood you. But for the ATC it has to be a valid ID as well as not expired or anything. So basically its all on the clerk to check it and deny them.

I think many of them are. Lets say you are downtown minding your own business, on foot or in a vehicle it doesn't matter, and a "streetwalker" attempts to solicit you. You tell her not no but hell no and call the police. I think you could press charges.

I would be pretty pissed that those bastards tried to ruin not only my day by arresting me as a john, but my reputation too.

ATC rules are frickin retarded

You can have a regular whose 24 years old forget his ID and if they bust in there and he doesn't have it and even if he later proves that he was over age, the bartender can get fined and fired

At the same time the bartenders don't have a responsibility to sniff out fakes. If you have a good fake ID there's nothing they can hold against the bar. But if your ID is expired by a day you're not supposed to sell it to them

Also from what I've heard ATC is usually pretty damn obvious whenever they pull off a sting.

I doubt it. Right to refuse service is always reserved to the bartender for any reason. I can't see how that law would be possible

In a lot of places that's entrapment and the charges would get thrown out. The john would have to approach the undercover officer.

In the case of the ATC sting, law enforcement is initiating the encounter so it should be considered entrapment and there should be no criminal case. However, if you think of a liquor license as a privilege and a business regulation, you could make an argument for fining the establishment.

All the kids they send us are very obvious, so I don't if that one agent is a dick or not.

I could see a scenario where a bar owner tells the bartenders they cannot refuse if a customer has a ID.

There was no one in the store but myself and my coworker, the clerk and the underage kid. The cops came in after the sale
