Pros: Less evidence against you and easier to fight in court

Cons: No license for a year even if you're sober

As long as your not shitfaced they will have no real evidence to convict you if you refuse it.

I think there's some way around the license thing. My dad is a criminal defense attorney and has always told me just to STFU if I get stopped while hammered.

Yep. And even if you lose your license, who gives a frick. You lose your license when you get a DUI too, but you're also paying thousands for the other punishments.

except for when they get a warrant and take a blood sample.

with the new DUI laws on the books, you might as well just blow.

They will not take your license for a year if they cant convict you and your lawyer is not an idiot.

um, I'd give plenty of fricks if I was sober and they took my license away

the only hope you have is to deny you ever had anything to drink, deny the breathlyzer and hope you can go to jail and sober up enough b/4 they do the blood test and when they do you pass.

if you've had 4-5, don't say you've had a couple, just say nothing you just don't feel good

At least per Georgia law, if you get asked to submit to a breathalyzer and refuse, you lose your license for a year no questions asked. So if you have a chance of being below, you might as well blow.

Except the testimony of the officers and results of the field sobriety tests...which nobody passes.

Doesn't matter in Arizona because the fricking police here will physically restrain you and take your blood. It's so fricked up!

Just because they CAN doesn't mean they will. Had a friend refuse to blow last week and no blood sample was even brought up in conversation.

Also unless its a checkpoint with the big bus, the time it takes to obtain the warrant and take you to the hospital not only takes long enough for your blood alcohol level to lower.. It decreases that cop's chance of catching people who don't know not to blow so he likely won't bother with you.

Blood samples really only come into play when its a DUI setup with someone ready to take blood.

A DUI attorney on the MS Gulf Coast said they are doing it there too.

My oldest daughter is going through this. She passed the field sobriety, refused to blow and was taken to jail, will probably lose her license for a while.

She wasn't intoxicated, but refused to blow.
