I'd worry about saving my kid first and settling the question of who owns the dog later.
And for the record, I'd not recommend trying to shoot a dog while it's attached to a child. You run too big of a risk of accidentally hitting the child.

The DA will charge the family with failing to supervise their child, but the resisting arrest charge against the kid was dropped.

My favorite is when the officers leave the dog locked in the car in the middle of the summer until it dies from the heat. Police dogs are only police officers when it suits them best, the rest of the time they are just dogs.

In the OP scenario - dog escapes its kennel and is uncontrolled and attacks a child - then yes, you are justified in using lethal force to stop the dog.
The fact that it's a police K9 is irrelevant in that scenario because the dog isn't under the control of a handler acting in an official capacity. In the OP scenario it's simply a dangerous dog that has gotten loose and is attacking a child.
