OP surely read the article. He's not the one who made the initial accusation in the case, but publicly stating that the guy is a pedophile is a pretty shitty thing to do.

I don’t know if this has been discussed or not, but if she faked a picture or altered one that showed him in some sort of sexual act with a minor, couldn’t she be charged with possession of child pornography or something like that? Clearly there is some sort of “sexual” enough photo evidence that she had. Could that not constitute a charge like CP?

Benefit of the child.
She goes to jail, kid goes to foster care.
Possession/creations in this case isn’t similar to other cases as the motivation wasn’t child exploitation but more system exploitation (revenge)
Also child crimes have high recidivism and recidivism is not really a concern in this case.
So it would cost the system and be more detrimental to the child and to punish her than to not punish her.

I'm the disabled war veteran who was falsely accused! The image was allegedly found on a CD. It wasn't a photograph but a tiny Thumbnail. And I wasn't in it. The male in the image couldn't be identified. The entire case was a carefully planned CONSPIRACY to give the estranged wife an unfair advantage in her divorce she filed the day prior to her false allegations.
