Ot lawyers: lease question mold involved...money board sent me here

Long story short, I have a fairly high end rental, wont discuss specifics but the building im in had a significant water main leak from the 20th floor down to the 7th...for the past 5 days Ive been sleeping on the floor in the living room while fans were drying the walls in my bedroom.

Yesterday the bulding security and a mold company came into the condo and said my condo had mold behind the laundry machine and they cut out a significant chunk of the wall and i took pictures of it and they sprayed some stuff and put a piece of something over the wall and taped it.....the fans continue to dry in my bedroom and they have some other machine with a long tub dumping little bits of water into my bathtub

Also My gf has been having horrible headaches the last few months and has gone to 3 doctors and none have found anything wrong with her and now im starting to believe it may have been from this mold.....anyways...

Anyways this has all become a pain in the you know what especially when your rent is as high as mine is....frankly the building isnt as high end as they made it seem when i signed the lease and id rather go live somewhere else....anyways the unit is owned by an individual and not the building....so can I get out of the lease now? what steps would I need to take if I can....

Also upon move in I paid first,last, and security so 3 months rent.....what can be done about the last 2 in the event i can move out legally.....landlord is rich guy in Argentina.....also is there anything to do to see if my gf current headaches are tied to this mold issue bc she never had them....

This lease in LA?
You'll have little to no legal recourse, if so.

Currently, no mold limits have been set by the EPA or LDEQ.

If they fixed the mold problem, then you probably can't get your money back. Of course, you can always move out without paying anymore rent if they find someone to lease it, which they have to do anyway.

As for the girlfriend, take her to a specialist. She can sue in tort if there is a connection.

I don't know about down there, but up here if there is a serious mold issue in a place the health department comes in and shuts it down. The rent abates or the landlord has to pay for a comparable place until the apartment is deemed habitable by the health department.

Usually it is difficult to prove the causal relation between some vague illness and mold. I have seen verdicts for the landlord on the causation issue.

Also, is your girlfriend on the lease? If not she may not have a claim against the landlord.

Consult a competent attorney down there to get real advice. Good luck.

LDEQ doesn't regulate indoor air quality at all. You might check with DHHS.

I am not an attorney so I can't help you there. However, you can easily establish whether or not you have a mold problem by spending a little money on some air sampling. Make sure you call someone with a proven track record. The firm that performs the air sampling must not also be a mold remediation firm (conflict). This sampling would likely cost between $200 and $400. If the results indicate a problem, then I would start with the local health department.

From working around mold a couple of months after Katrina, mold exposure just feels like you are getting a sinus infection. It went away for me after the second day, but I am a Billy badass

Air sampling results really aren't comparable to any limits, since none have been set.

Typically, if indoor airborne concentrations exceed the outdoor concentrations at the time of sampling, you have an indoor air quality problem.
