His mother, Luanne Haygood, who was filming the emotional scene, said she and her son had been called into the school for state standardizing testing April 12; while they were there, she said, officers arrested her son for an incident that occurred in October.

He spent the night behind bars at a juvenile facility, Haygood said.

Isn't that required? (I don't know the entirety of Miranda rights)

I am pretty sure. And if so, the police will have a lawsuit on their hands.
EDT: actually no, I believe only in New York are police required to tell a person why they are being arrested.

Ah, okay.

Follow up: Is it standard procedure to attempt to physically restrain/move an autistic 10 year old and then file battery charges against him when he doesn't comply?

doesnt have to at the time of arrest.

How did the kid have a warrant for that and the parent's not know? And why are they being called into the school for state standardized testing? Shouldn't he already be there for that and if so why are the cops involved?

I can't help but feel like this is a shitshow on so many levels.

Yes there is more to the story. Apparently he was expelled in October after the incident. He returned to school only for standardized testing in April. He was arrested then.

well how else are you going to take him into custody? Bucket of food? I'd imagine the battery charges are filed for procedural purposes.

If a cop handcuffed a ten year old and refused to tell the child's legal guardian why the child was being detained/arrested, and it's all on video, I'd think that cop is going to be looking for a new job. But I bet this story is bullshite.

Either the mother doesn't have custodial rights, or a warrant was issued for the October incident and they never appeared in court, or something else led to the child being taken away. If mom doesn't know why the child was arrested, how does she know it was for something that happened in October?

I think it's fricked up if they held an autustic kid overnight, but there's got to be more to this story.
