Officer charged with criminal homicide after shooting suspect who was facedown

Authorities accused Hummelstown police Officer Lisa J. Mearkle of shooting 59-year-old David Kassick twice on Feb. 2 without legal justification. She was released on $250,000 bail.
Authorities said Mearkle had attempted to pull over Kassick for expired inspection and emissions stickers before he sped away. She caught up to Kassick near his sister's home where he had been living for a short time.
He got out and ran before Mearkle incapacitated him with a stun gun, held in her left hand. He was on the ground when she shot him twice in the back with the gun in her right hand, police said.
Mearkle, 36, told investigators she fired because he would not show her his hands and she thought he was reaching into his jacket for a gun. Perry said she did not know Kassick before the shooting.

Idk...the article said that suspect had been incapacitated with the stun gun and was lying facedown when shot. Sounds like the officer didn't perceive the threat appropriately.

Huge violation of technique to have the Taser and pistol out at the same time. Causes things like this and easily explains the first shot. But the second? Wow.

On another note, from the police departments press release:
"We are servants of justice and must now allow the judicial process to conduct a fair and impartial review of the allegations that have been presented," the news release stated.
They "MUST ALLOW" it? What idiot writes these things? After the Ferguson fiasco you would think they would take the time to phrase these carefully.
How about "We are servants of Justice and know that the judicial process will..."

As they should. From the facts that are presented, she was in no immediate danger and had control of the situation. If this was a life/death shoot out with multiple people and she had to put the guy down so he didn't attack her from behind I could see something like this being warranted, but not here.

Why is it proper protocol to chase down expired inspection stickers and traffic violations? Take the license, radio ahead.... They'll get them eventually.
